Trump’s plan if the Supreme Court blocks tariffs

The Supreme Court is about to rule on. the the the the legal kind of. foundations of the the biggest tariff. package you have is the declaration that. there's an international economic. emergency underway. If they rule against. your government and say that that legal. base doesn't work, you have a plan B. >> Yes. >> If they say you have to refund all of. the tariff revenues you've collected, that's like a hundred billion dollars, something like that. Is that right? >> That's about right. >> How how does that work? >> There are precedents for this. If you. look back, you know, we had some.

litigation in the United States over. what's called a harbor maintenance fee. in the United States and our court of. international trade. The court itself. kind of helped administer that program. So, I expect if if if there's, you know, if the worst case scenario happens and. the courts, you know, uh overturn what's. happening, the courts will also have. some say in in how that might work, how. that process might work. And if. businesses are panicking that that the. replacement, the plan B will be just. like a tangle of a million different. bits of tariff legislation, the. complexity, that's a big big worry for.

business. That's that's a reasonable. worry. No. >> Yeah. So, I can certainly understand why. they would worry about that. I think our. goal is if we have to find a way to set. up uh a replacement system uh would be. to have as much continuity as possible. You know, I mentioned before that there. are certain things that are subject to. tariffs, certain things that aren't. Our. goal would be to preserve that as much. as possible. Um I you know we have. agreements in place with a lot of. countries where they've agreed to open. their markets and they've agreed that we. can have a certain tariff level against. them. Uh all of those agreements stay in.

place, right? Just because the Supreme. Court. >> but it's going to be more complicated, right? >> Uh yeah, it's inherently more. complicated. I mean the president chose. to use because it gives the flexibility. It's a single tool and we can use it. Uh. the other thing to keep in mind is some. of the other tariff authorities that. have been quite important over the past. year include section 232 tariffs and. section 301 tariffs. They're not an. issue in this litigation and so that. will all stay uh in play.
