Trump DOJ PANICS as Meidas WINS RULING on DARK PAST!
Donald Trump and his Department of. Justice are panicking after a Midas. Touch host won a major court order in a. Washington, D.C. federal court under the. Epstein Transparency Act to release a. set of redacted documents and also to. provide a redaction log or privilege log. of documents that are still being. withheld by the Department of Justice in. connection with the Epstein Transparency. Act. So, all of the documents that are.
not being turned over, what's the basis. and grounds for which you are not. turning them over? Is there some. privilege? Is there some other exemption. that you believe you don't have to turn. over these documents? And we're talking. about potentially millions of documents. And we believe, and Katie Phang, the. Midas Touch host who brought this. lawsuit, believes also that the Trump. regime is making very improper executive. privilege, deliberative process.
privilege, and other assertions of. privilege that would not withstand. scrutiny in order to not turn over some. of the most damning evidence against. Donald Trump and against others in the. Epstein class. So, Trump's DOJ said that. they are now filing an emergency appeal. after the Midas host, Katie Phang, won. this very important order from Judge. Sullivan in Washington, D.C. The. Department of Justice, get this, is. calling the federal judge perverse. While the Trump regime covers up the.
Epstein files, they're calling the. federal judge perverse and say that this. judge did a perverse ruling regarding. Blanche and the Epstein files, and that. they will be filing an emergency appeal. A spokesperson for the Justice. Department said Todd Blanche has not. conceded anything. Judge Sullivan's. perverse interpretation appears to be. focused on drawing misleading headlines. This judge is suggesting DOJ violate the.
law by unredacting victim names who, as. the department has always explained, sadly became co-conspirators. DOJ has produced all responsive. documents and will appeal this decision. with confidence, the spokesperson said. Notably, the DOJ focused on one small. portion of Judge Sullivan's 48-page. opinion where Judge Sullivan said these. redactions by the DOJ without a.
privilege log or redaction log seem to. concede the violation because you have. to do a privilege log or redaction log. and explain what's happening. But the. ruling by Judge Sullivan in 48 pages was. much deeper than that. Uh Midas Touch. host Katie Phang requested another. series of documents that seem to be. relating to Donald Trump and Trump being. mentioned in the Epstein files where the. redactions seem to be improper. And just. in general, uh produce a redaction or.
privilege log and let us know why you. haven't turned over all these other. documents. We know there are documents. that are not being turned over. The DOJ. has said as much. They just claim that. they have the right to not turn over. these documents because they but claim. it's not responsive or because there are. all of these privileges. So, a. the fact that they are not willing to. comply with Judge Sullivan's order and. if they've produced everything, all they. would have to do in response to Judge.
Sullivan's order by the early July date. when it's due is, guess what, put under. penalty of perjury. I know the Trump. regime hates to do this, a declaration. that says, "Judge, we've turned over. everything. There is nothing else that. exists." And then they would fulfill. their obligation. But of course they. never do anything under penalty of. perjury. We've seen this for example. with the January 6th slush fund where. they're not going to put it under. penalty of perjury. Um so there's that.
and also produce a privilege log. The. The Epstein Transparency Act says for. what you withhold or where you have. redactions, you have to go and identify. each document and then you have to list. the specific grounds why you've either. redacted something or why there are. documents that are not being turned. over. We know from Pam Bondi's It was. supposed to be a. It was supposed to be a deposition um. and uh Howard Lutnick's uh supposed to.
be a deposition but it ended up being. informal meetings with the House. Oversight Committee that you know, for. example with Pam Bondi when she was. being represented or. rather a DOJ lawyer was there basically. acting as her counsel but making these. objections, they were objecting on the. grounds of executive privilege to say. Bondi couldn't even talk about Trump. Um. they were saying that there were. deliberative process privileges and. other privileges why Bondi couldn't talk. about her communications with other. executive branch officials and other.
people in the DOJ. And so they were. using these privileges as a way to hide. her testimony and so obviously a lot of. the documents that are not being. produced are likely being withheld on. the basis of privilege so the DOJ can. say this, "We've turned over all the. documents that we were lawfully required. to turn over.". But then it's like, "Oh, that's your. interpretation of what's lawful?" It's.
Donald Trump and Todd Blanche's. interpretations of what's lawful or get. this, just put a list, put a log, let us. know what's not been produced, be. transparent with the court and if you're. right, it should be very easy. You. should be rushing to Judge Sullivan and. say, "Judge, here's our declaration. Everything's been produced." Cuz that's. what normally happens in any litigation. Let me bring in Harry Litman from the. Talking Fed's YouTube channel, Talking. Fed's podcast, and Talking Fed's. Substack. Harry, great to see you. You.
know, let's talk about this. All you. would say when I was a litigator, and. you would have a document production, not even a law that said you have to. turn over, but you would have a document. production obligation, you would have to. do an affidavit at the end swearing. under penalty of perjury that you turned. over all of the documents. And then if. you were withholding documents, you had. to do a privilege log. That was without. a actual law called the Epstein. Transparency Law. That was in every. other case that I was in. It had nothing. to do with the Epstein case. It was just. that's how you handle stuff as a.
litigation. So, here they go calling the. judge perverse. "We're going to appeal. We're going to appeal." Versus if they. had nothing to hide, you would just go, "Hey Judge Sullivan, here's our. declaration. We've turned over. everything. Done. Easy." What do you. make of it all, Harry? >> Yeah, you started with the big point, uh. Ben. They say in this press release, "I. don't think you'll see them signing an. affidavit. We have produced all. responsive documents." And the rabbit is. deeply in the hat there. They're.
alleging and it's it's uh completely. deceptive. Katie, as you I mean, you. know her very well, that that is uh a. misconstruction of only one of her. requests. But what she wants are things. that they plainly haven't turned over. So, first, they redacted the names of. senders and recipients in eight email. exchanges with Epstein. No doubt that's. a mistake. They need to remedy it, and.
they haven't. They've also redacted the. names of co-defendants in a draft. indictment. That's probably what they're. talking about when they say she's trying. to push us to reveal victims names as if. that's what the Katie suit is about. Third, they have there's you're supposed. to have everything mentioning Trump and. they haven't. Um fourth, they haven't. done anything. They just categorically exempt anything. in foreign languages. And then fifth,
and this is the main point uh that you. were just making at the end, there's no. possible justification here. They needed. to have redaction logs that every. redaction you explain why somebody can. double-check you and the like. They They. have just produced zero redaction logs. There is no serious argument that, as. they say, they have fully They They just. simply decided, "We're going to not do. it after, by the way, being very way.
more than a day late and way more than a. dollar short, and just said, 'We stop. now. We've produced all responsive. documents because we say so.' So, that. notion, I think, can't. can't really carry any water at all. Now, Katie suit is a really interesting. one and I There's two points to raise in. that they're going to be talking about. when they run up to the DC Circuit. First is the standing argument, and it's.
a really good one or a really clever. one, I should say. And if it prevails, I'm not sure it will all the all the way. up, but if it does prevail, you and the. Midas Mighty and I and all kinds of. people who really make their living by. doing commentating are much empowered, because what Judge Sullivan said is. informational injury. Katie Fang goes. through all these documents. That's how.
she, in fact, does many of her YouTubes. That's That hurts her economically that. they've been. withheld. and she's got an a so-called. informational. injury and that's something that some. courts have green-lighted, others have. not. Right now, if it if it goes up in. the next few days, the panel that will. greet it is a sort of down the middle DC. Circuit panel with a strong Trump. um.
make me Supreme Court Justice, please uh. judge, a a mean pillar, a strong uh. Obama appointee, and a sort of hard to. gauge down the middle Republican. appointee Judge Henderson. Lastly, um this we have not conceded anything is. their attempt to cover up a really. embarrassing situation. They pushed back. on Katie by saying, "Hey, if you want. this, go to FOIA. That's where you can. get it all." And Katie had all these.
arguments saying and and Sullivan. accepted them, "FOIA won't do it. You. get these exemptions under FOIA that. uh won't uh enable me to get the. documents I need. Um not to mention that. as you say, and this is really. important, that scene transparency act. is a free-standing law. It sets the. rules for what have to be has to be. turned over. But, um Katie came in with an extra. submission to Judge Sullivan that really.
um obviously made him uh blow his stack. because it showed that the department. elsewhere was saying, "You can't do a. FOIA, do Epstein." So, they're just. contradicting themselves and Sullivan. told them, "I want a response to this by. Thursday at 1:00 p.m." They got no. response and he is he is using case law. that exists, but you know, the we'll see. whether the court of appeals thinks it's.
uh he hasn't gone a little over the. line, but that case law says if you. don't answer something you've conceded. it. So we're seeing all these headlines. in papers around the country. Blanche. concedes he he got it wrong, etc. I. think that's a little bit of a massaged. reading. But bottom line, all kinds of. they have not produced and need to. And if Fang. who as you know, you know, a great. colleague, great advocate, and.
the lawyers here, Brendan Bialu, among. others, who are representing her, you. know, if they can make this. informational standing point stick, that's going to be useful in a wide. range of situations. >> I think it's very telling as well though. that the Trump regime is fighting this. because. that that to me also is revealing almost. regardless of the outcome. And of course. I hope and we all hope that Katie. prevails and that the Trump regime is.
compelled to release these file. I I. think that, you know, I I would I would. never underestimate Katie. This. lawsuit's already been executed and I. think a brilliant brilliant way. But. it's how revealing is it that this is. their response? You know, they're going. to holler right away and it. kind of, you know, shows you what. they're hiding because as you and I have. said, the easiest response if you turned. it over that moots this lawsuit the same.
way you would moot the January 6th slush. fund, you would moot all of these things. is just say, "Okay, here's my declaration under penalty of. perjury. Everything has been produced. Here's my log just so you can see where. the DOJ. We've got a lot of resources. We've done privilege logs before on. cases involving. terabytes and terabytes. We know how to. do this stuff. Dot our eyes, cross our. tees. we handle it professionally, we're. out. It's It's It's easy. It's an easy.
answer if you're doing it the right way, and you get this if you're concealing. and you're hiding. Any final words, Harry? >> Just so uh the idea that these two and a. half million-dollar document. two and a half million documents that. are missing, that they somehow have just. asserted that they have actually. uh produced everything or everything as. they put it as responsive. to use a word from a district court. judge just yesterday.
uh to saying to the administration is. risible. There is no freaking way in the. world they have complied with. uh the Einstein Transparency Act, and. they are just trying to brazen it out. >> Epstein Transparency Act.
