🚨GOP Jack Smith STUNT JUST BACKFIRED…
So, what do you do when you're a MAGA. Republican senator and you attack. lawyers for filing frivolous lawsuits. and you call for tort reform? What do. you do when you're responsible for. making the cost of living crisis way. worse for your own constituents? What's. a good distraction that kind of ties all. of your corruption and idiocracy. together? Got it. Well, MAGA Republican. Senator Marsha Blackburn of Tennessee. said, "Let me show you some performative.
latigious outrage right now. I am going. to sue special counsel Jack Smith in. Tennessee federal court for the Arctic. Frost investigation." And we'll call it. Arctic Frost, so it sounds really scary. And the reality is when special counsel. Jack Smith was investigating Donald. Trump for, I don't know, trying to coup. trying to overturn the 2020 election, there were a number of senators. Not.
their actual messages. They weren't. wiretapped, but phone records that. simply showed who was calling and how. long a call lasted. basically metadata. that was obtained lawfully by special. counsel Jack Smith with warrants that. were obtained with probable cause signed. by magistrate judge as part of a lawful. criminal investigation. But Marsha.
Blackburn says my rights were violated. You were able to find out my number. spoke to this number for 2 minutes and. 37 seconds. How dare you intrude into my. life when a magistrate judge said there. was probable cause. And while we're at. it, let's put flack cameras everywhere. Let's invade your privacy by having. Donald Trump's Border Patrol and Ice. Gustapo in your cities. Let's tread on.
you in every which way. violate all of. your actual rights. We'll spy on you. We'll have big tech. Big tech's our. friend now in the Republican party. Not. sure if you saw the big tech party with. Xi Jinping, but like we're all cool now. and we're all spying on you and we're. putting data centers everywhere, but. don't you dare get a lawful search. warrant that shows the time of a phone. call. And I'm just going to exaggerate. it and claim that you somehow intervened.
in my life. Well, she files this lawsuit. on September 30th against special. counsel Jacks Smith. She files it in. Tennessee federal court. Every single. Tennessee federal judge said, "We're. recusing ourselves from this because. where there's a Tennessee federal. official, the senator, we cannot hear. this case." So, they all rejected it. The case now has to be assigned to a. district court judge in some other.
district. And there's a whole process. for how they figure out where this case. ends up going. But I think this case is. going to backfire in a number of other. ways. I mean, she's seeking nominal. damages, which in theory means she's not. seeking like millions of dollars for. herself. She's just saying, "I want uh. $1, I want to I want to be proved that. my rights are vindicated." Then she also. wants like injunctive relief, which is. odd because we're in 2026 now. And so.
usually an injunction deals with the. possibility of the future conduct. happening. And so what does she wants? A. judicial order that basically just says, "Marsha, Marsha, Marsha, you were right. to be mad, Marsha." I'm not really sure. that's a place for the court of law to. do. I want to bring in Harry Litman from. the Talking Feds YouTube channel, Substack and Podcast. She wants a Marsha. Marsha Marsha order. I'm not sure that's. what federal courts are for, but I just.
think, you know, you're heading into the. midterms, cost of living crisis getting. worse, catastrophic war in Iran, never. ending, things are bad. So, it's like. the Senate, they bring in Jack Smith. because they're trying to play their old. hits to their base. And it's like, just. stop this stupid crap. There's real. stuff. It's such a waste of judicial. resources. And she's the kind of person. who's like, "We need tort reform. There's too many lousy lawsuits that are. going on here. It's like the lousiest. lawsuit." And is it. does she have any sense of it or is it a. stunt that she thinks will at least not. be shot down as it will be and I'll. explain in a second uh before the. midterms and it's one of those sort. sorts of strategies. this uh recurring zombie. it. She is so. wrong in 20 ways, as were all the. justices who expressed outrage. Uh, and. they and really knew better. Cruz and. and others at the Jack Smith hearing. Step back. Jack Smith is investigating a. crime completely legitimately. The. target is Donald Trump. the uh essential.
kind of of the the the very sum and. substance of the proof is to put. together everything that happened. January 6. There's I'm sure a big. whiteboard in the office and it says, you know, here's the speech at the. Ellipse. Here he's going back and he's. like Nero the whole afternoon with the. flames going up and that is really. important to show his guilt. Now, back. on the Hill, you have some uh senators, you know, running for their lives, but.
others during that hours are calling up. usually Mark Meadows and in a total uh. panic saying, "Get him to stop, etc.". And as you say, point number one, this. is not a wire tap. All it is is such and. such a number. And by the way, we we. know it came from here's who it is went. to Mark Meadows at such and such a time. And you mark those up and you can put. together the Trump uh day um and and how.
it was spent. It is an absolutely. elementary thing any prosecutor would do. and would have to do and it doesn't. remotely. um have any um illegality or otherwise. So she's coming in first there's this. confusion again and again as if they. were wiretapped. They weren't. It's as. you say here's the number and how long. it was. But second they are witnesses.
here. It's it's not a speech or or. debate violation. First, they're not. engaging in legislative action, but even. if they were, they're not being arrest. What the speech or debate clause says is. you can't arrest or otherwise penalize. They are witnesses here. You saw. the exchange between Jack Smith and. Lindsey Graham's sister. He said, "I I. think your husband was a great patriot. and he would have been a witness as.
indeed they would have been. This is how. you're going to prove what happened all. during the day. And having these again, just pin records for for um that you get. with a subpoena with the phone number. and how long it was is essential. That's. how you prove the case. Zero zero um. kind of application for a speech or. debate clause. This is even even if. there was some privilege here, we're at. US versus Nixon. If there's a if there's.
actual evidence of a crime like somebody. called Mark Meadows for four minutes. etc. even if there were pre a privilege, it would yield. So, no speech or debate, no um oversight or any kind of capture. of words, no possible um uh treatment of. her under the under any constitutional. bomb because they are witnesses and the. Supreme Court and then make it clear you.
have to do it. So, they keep again and. again feigning outrage at these. hearings. It's one of the reasons that, you know, having uh the the reports. might, you know, could be really uh just. just a good way to be able to fight. back. But the whole thing is just total. uh garbage top to bottom. Now, it's. interesting all the um Tennessee just. said, you know, I think I'd rather not.
deal with this one. It's a little bit. like what happened though with the US. attorneys when they decided is hagan. validly appointed whatever they give it. to a district judge in another district. That's not exactly the same. All she is. is a senator there. But I'm sure when. they look at it uh and they talk to. their clerks, they they know right away. it's a stone cold loser and uh they. don't want to um um get the outrage of. the local Republican senator from. Tennessee. But it is there. It It's.
just, you know, uh, as as people used to. say when I was clerking, it's a loser. anyway you look at it. And it's more. than that. It's outrageous because. there's all this false uh, chest beating. and outrage for something that is not. just legit, but a compulsory no. prosecutor would not do this. And. there's not the slightest suggestion. that there's anything wrong under the. law with doing it. There are witnesses.
like anyone else. If they'd walked and. there was a car accident and there was a. they might have to testify. Same thing. if they called and spent a few minutes. on the phone uh with Mark Meadows and. what that would reveal about how Donald. Trump spent his January 6. It's total. total DOA. Well, you know, it'll be uh you know, it's gets the headline. you know, it's. another headline lawsuit. Um, but you.
know, look, what's she gonna do? Is she. gonna It'd be interesting to play out. and take depositions. I mean, what does. this even look like? It's like they. don't And then they're going to whine. I'm too busy. I'm too senator speech or. debate clause. I can't talk about that. You know, it'll be fascinating though. Special counsel Jack Smith is like, I'm. going to litigate this. You know, she's. going to try to make objections to. questions and say speech and debate and. all of these things like, "You can't ask. me that. You can't ask me that.". >> Right? You always made the great point, Ben Howa. If you were sued, you'd be. going for the deposition right away. And.
I can see it. I think this one gets. dismissed before. I think it goes away. on a motion to dismiss so we don't get. to discovery. >> Yeah. Look, you know, from my view, and. I said this, I said if Trump ever sues. me, I would not file a motion to. dismiss, right? >> I would answer the complaint. I would do. his deposition. I would turn over all my. documents right away. What the do I. Excuse me. what do I have to hide? You. know, and then I would say and then I. would say, "All right, I want a trial.
>> Let's let's bring you into a trial and. let's just do it. You know, let's do it. publicly. Take the witness stand. You're. the plaintiff." And he'll dismiss it. He's not going to show up to the trial. He's not testifying. You know, he's. shown that over and over and over again. What are you going to do? You going to. sue me on the Epstein F? I'm I will do. your whole history in front of the jury. about being found civily liable in. Eugene Carol for sexual assault. I'll. play your audio where you talked about. sexually assaulted women because you're. rich. What are you going to do when I.
call you a fraud? Okay, we'll go through. all of your casino bankruptcies. We'll. go over all of the stuff that you did. We'll go over all of it. What are you g. You know, and so look, the Wall Street. Journal, the New York Times, they have. the same playbook. They get sued. They. file a 12. It's it's like the rules are. established before, which is all right, he's going to do the performative. lawsuit against us. We'll send it to the. insurance carrier. They'll file the. motion to dismiss. It'll drag on for two. years or three years. I bet you they.
even budget it with the carrier. A Trump. lawsuit costs $300,000. It's for real, right? They're like, "This is this is the life cycle of it. We won't do his depo. They won't do our. depo. He'll lose. He'll whine about it. and it's like enough. Go gloves off. Take his deposition, you know, right. away. He's going to run you when you. when you do it. And you know, anyway, that's my strategy.
