FURIOUS Judge REPRIMANDS Trump over EVIDENCE DESTRUCTION!!!

Here's what a judge said to the Trump. regime. You touch and you alter that. reflecting pool at your own peril. This. was in connection with the Trump. regime's felony criminal prosecution of. David Hearn, the two-time Olympic. canoeist who put his hand into the. reflecting pool when there was a lot of. attention based on all of the algae and. all of its destruction caused by the. shoddy work that was being done and by. Donald Trump's rejection of just the way.

you actually assemble a reflecting pool. like that. But of course, Trump regime. needed a scapegoat anyway. He figured, "Who should I scapegoat?" Maybe a. two-time Olympic canoeist who fought for. this country, represented our country in. the Olympics, David Hearn. Uh you had uh. Janine Pirro, Donald Trump's United. States Attorney for DC, give one of the. most bizarre press conferences you've. ever seen. "We're going to prosecute. him. We're going for David Hearn." He. just And and so as we said on the Midas. Touch channel, "It won't work. Okay,

that's the best day you're ever going to. have." And it was really weird, Trump. regime. Now you got to litigate this. case. So now David Hearn's lawyers are. saying, "Okay, now the Trump regime has done what's. called spoliation of evidence. They went. back into what they're claiming is the. scene of the crime and they started. tampering with it. They were the ones. who went in afterwards drained the. reflecting pool. They put their crew. there. The original contractor, who by. the way he was like a Trump donor and.

Mar-a-Lago guy and has all these he's. connections with MAGA, his company is. now still the company doing this work. Um they went back in, they started. messing with it. I'm sure you've seen. the photos where it's not even blue. anymore. I you know, it's what happens. when you put hydrogen peroxide and you. dump it. Yes, you will kill the ducks. and you will remove the uh lining on the. bottom. Also, when you drive over it. with uh, your motorcade while it's being. assembled, probably not a good thing,

uh, to do with all of the weight of the. motorcade. But, uh, a motion to dismiss. was filed by David Hern's lawyers on. there's numerous grounds but that. they're going to do this. But, one of. the main grounds right now is. spoliation. You can't destroy the the. what you claim is the crime scene. You. can alter it. And by the way, the United. States attorneys, the prosecutors, not. Jeanine Pirro who shows up for the press. conference and does the hits on state.

regime media, Fox News. No, no, no. The. line prosecutors, the people who are. thrown in there to have to deal with it, they don't, you know, and we've seen. this over and over again. They weren't. alerted that what was going to happen. They don't know what's happening. And. they're the ones who have what's called. Brady obligations. They're the ones who. are who are required by the law to turn. over exculpatory evidence and. information. And whoa, is there going to. be a lot of exculpatory information on.

this one the the communications from the. contractor, all of the emails and text. message, all of these things, the. prosecutors are responsible for turning. all of that over. Separately from the. spoliation motion, if they don't turn. over the Brady material, the exculpatory. stuff, which is within the province of. the federal government, the case can get. dismissed on that basis as well. There's. numerous the grounds and also. we talked about this in another video we. did, you know, Trump has made himself.

like one of the main witnesses in this. as well. And so, to me, a lot of the. discovery and exculpatory information. comes from Trump's messages. And so, you. know, he's going to do what he's done in. the BBC case and all these others, executive privilege, I have the right to. go on my social media and lie and to. weaponize the government and do all of. these things, but don't you dare ask me. to actually justify anything. I'm not going to do that. And so, boom,

right away David Hern's lawyers filed. this motion to dismiss, zeroed in on an. area that's clearly an area of. sensitivity for the Trump regime. The. judge, a superior court judge, it's. actually in the DC superior case, but. still a felony charge, went to Trump's. lawyers, "Do you know about this?" And. the lawyers Trump's the prosecutors were. like, "No, we don't really know about. it." Not a great admission when you. don't know that that was even happening. during the case. And so, the judge said, "Okay, you know, you don't get I'm going. to treat this like any other case. If.

you, the federal prosecutors, you chose. to bring these charges, if you did not. you don't even know that it happened. But. what could have been an answer is, "Judge, we absolutely knew. We obviously. had to address it. So, here are the. steps we took to preserve evidence. We. reached out to the lawyers for the. defendants. We made sure this this and. this. We photographed it. We allowed. them to do an inspection before." That. happens. You know, you can't necessarily. just preserve a crime scene forever, but.

you coordinate. We let them do an. inspection. We let them videotape. We. let them bring in their experts so they. could see all of this. Nope, not here. They didn't do any of that. So, the. judge said, "Okay, I'm going to dig. deeper into this, but that could be a. grounds for a dismissal. It will be a. grounds for dismissal." And then Donald. Trump will say, "Oh, the radical. Obama, the radical judge, Trump hater. That's why I did it.". Loser behavior. Loser loser behavior. Comes down to that for me. And and.

And so, basically, I think of it. with. you know, my heart in some ways goes out. to these poor prosecutors who just. kicked in there. Nobody is thinking. about this now. Absolutely, somebody. needed to scapegoat. uh someone and they picked David Hern. In In some ways, it's equally if not.

more revolting as the reprisal. prosecutions. There, you could say, at. least perversely, he's going after his. enemies. Here, David Hern is just the. guy who happened to walk by and Trump. needed to advance his vandal stole the. handle uh scenario, and so they picked. on him and charged him with a felony. Now, the felony says to in order to get. up to felony level in the DC code that. he took this big chunk of it and ripped.

it out, etc. And they went to the pool. So, you you're It's not simply they do. have to give so-called Brady material, and that's not just a lot, it's the. Constitution that says if they have. anything that's good exculpatory. But. you've been involved in criminal trials, and people, you know, in the minus. mighty and fed head communities have. know. know how it works, perhaps. You can't just present evidence that. doesn't have a some showing that it's.

what you say it is, you know? The bank. robber's. um uh clothing, you know, you get it at. or or the gun or any You put it in a. bag, you put your initials on. So, come. time to go to court, you can actually. show. um this is the very thing I'm saying it. is. That's like so elementary. And they. just have at the pool without anybody. Oh, wait a second, we indicted someone.

They could very easily have simply given. up on They could have spoliated, as the. legal term goes. They could have just. messed with and no longer have. presentable evidence of this central. claim that Perot has made. I want to get. to her in a minute, too. This is the. other thing that gets me. all my. in a bundle is. she there's a this the indictment that. as you mentioned it just recites the.

language of the DC code. She went out. and talked about all these witnesses and. things they had seen that went outside. the four corners. That's itself a bad. ethical violation. But if it turns out not to be true, Ben, if they can't come forward or these. people who purport to be witnesses their. story breaks down as I tend to think it. will. That is, you know, really bar. discipline material to go outside the. four corners, say these things and you.

can't even, you know, cash that check. So, this thing has all the signs to me. as you say they had one day where they. could do the indictment and since then. it's been a downward spiral. I find it. unlikely for a number of reasons that. David Hearn's going to be convicted. He. is sort of the defendant from hell for. them. I'll bet they would love to just. give him a disorderly conduct plea. bargain or whatever and he wants he. wants to to go at it and this this is.

the very first motion out of the box and. the response from the government. attorneys, the ones who are there to. have to cover things coordinate through. the government and they're like. Uh-oh, we don't know. We I mean did we. did anyone in the government touch the. we we're not sure. That is really really. really a bad look and. you know, for now the the judge judge. gentleman has not dismissed the case, but he hasn't.

you know, ruled on this anyway, but it. to me this case has all the earmarks. of one that is, you know, going south. and fast and that's exactly where it. ought to go. >> I mean, the idea for a press hit. we have witnesses who say X, Y, and Z. may sound good. You may even have a. Trump supporter who was there. >> Right. >> for the 250th thing even though it was.

very poorly attended is an. understatement, you know, who was. wrapped up in the you know, in the. moment but then. take the stand. you know, it's like people who go into a. jury duty, right? They show up sometimes. and they're like, I'm going to tell him. that I hate the law or I hate plaintiffs. and that's how I'll get out of jury. duty. Okay, well, I understand that's. your plan. Then you show up in a court. judge is wearing the robe, there's the. great seal, the judge gives you.

admonitions about perjury and all of. these things and I found. the people who were out there saying, I'm going to do this. often even in a jury duty setting tends. to go, you know what? I may not go as far as I thought I was. going to go and try to dodge jury duty. and this is something profoundly. different and more significant. Which is. there are cameras in the area. You now. can be. engaged in perjury. The statute of.

limitations of which ain't going to. expire in the Trump regime alone and so. you're going to make yourself that. person. Okay, and then you start to get. the cold feet. Well, I you know, on a. decent cross-examination, what did you. see? Were you right there? Oh, so you saw his. hand was in there. Did you see him. actually grab anything out? Oh, you saw. him you saw his knuckles but did you see. anything in his hand? No, you didn't. So. you You know if he actually took.

anything or ripped it. You saw his hand. there. And by the way, who did you speak. to? Objection, objection. Well, is the. DOJ represent What's the objection? Did. they tell you that they wanted you to. say this? Yes. And what else did they. say to you? >> That's how any anything before we. >> You're totally I was I was I was. chomping at the bit to do just that, but. you're right. That's the first order of. Miss Maga. You were at the pool that. day. Yes. When did you first talk to. anybody about what happened? Oh, that.

officer. What did he ask? It's all It's. all absolutely. admissible going to. credibility and position to see it, and. it's got to tell, right? A It seems very. likely tells a bad story about how this. case came to be. I I the suspense to me. here, Ben, is will it go to the jury at. all? And by the way, something to. mention about DC Superior Court, those. cases move a lot more quickly. Uh they.

get set for trial, they go to trial. This could happen if they're not able to. dismiss, and. but then I think it will would collapse. in front of a jury. But that that to me. is whether things like this, spoliation of evidence, not passing on. Brady, will that be enough to give the. court a wherewithal to say, "Case. dismissed. We're not even going further." Or will. it go to trial, which in some ways, think of the sandwich guy say,

uh could be even more embarrassing for. the administration what it's done.
