Donald Trump suffering another big loss. to New York Attorney General Leticia. James. Yep, she's back. Donald, the. second circuit court of appeals ruled in. a 2:1 decision that John Sarone was. illegally appointed as an interim United. States attorney when he obtained grand. jury subpoenas to go after New York. Attorney General Leticia James. Not. surprising. A Trump hack federal judge. was in the descent. But this was an.

order consistent with nationwide federal. orders where Donald Trump and his rogue. DOJ would try to keep these individuals. as interim United States attorneys. without going through the Senate. confirmation process. And then they. would try to move people around within. the United States attorney's offices so. that they would fire these subordinate.

officers or these subordinate employees. so that there was nobody else to. actually take the job when the term. limit of the specific United States. attorney expired within which period. they'd have to be confirmed. Ju just so. everybody knows this is a uniquely Trump. issue. This is not something we had to. talk about in other presidential. administrations. What would always happen is the. president of the United States would. appoint United States attorneys in the. various United States Attorney office.

districts throughout the country. So if. there was an northern district of New. York, that's where this happened. But. there's a southern district of New York. and an eastern district of New York. Or. in California, there's a central. district, an eastern district, a. southern district, a northern district. There's a United States attorney for. each of these places. For each of these. districts, the president appoints. Then. they have to be confirmed by the Senate. They show up in front of the Senate. They get asked questions. And you know,

sometimes the Senate will have issue. You may issues. If it's a Democratic. administration, there may be a state. that has two Republican senators and. they may not like the person that you. appoint. So, the president would then. have to, you know what, like do a deal. and like reach out to the senators and. say, "Look, we're going to have to. appoint somebody. I know that this. person's not your ideal pick, but this. person, you know, may be more in line. with with you, or are you okay, you. know, with this person?" You know,

because these senators have what's. called the blue slip. I won't get into. the process, but they have the ability. to potentially, you know, void certain, you know, people. But, you know, but you. cut a deal and you figure it out and you. and and you work through it. You. withdraw the nominee, you put somebody. in, they get confirmed, maybe the maybe. they get through the judiciary committee. or the respective committee, maybe it's. a close vote in the Senate, and then you. do the next person. That's it. Simple. There's never issues. But what Trump. would do is he would just appoint. somebody. Then he would not even try to. even have them go through a confirmation.

process. And then they would their term. would expire, but then they would stay. in there. Then they would be challenged. and then they would then be like, "Okay, well now we're going to be serving as. like a phantom interim. We're not going. to call ourselves interim, but we're. going to exercise the same powers." Or. just bizarre procedural stuff where. federal judges have been like, "We see. what you're doing. You can't get around. the appointment clause." And that's what. basically happened with this John Cirone. guy. And then it's often these people.

who were engaged in these really um kind. of heinous investigations against people. who Donald Trump hates. Whether it's. Leticia James, whether it was Alina Haba. ga engaging in, you know, the same. conduct in New Jersey, whether it was. Lindseay Halligan in Virginia going. after also Leticia James and uh James. Comey and others. Um why don't we bring. in a former United States attorney,

States attorney for the Western District. of Pennsylvania. So you had to be. appointed and you had to go through this. process. So you know what that's like. and you I'm sure had to go around and. meet with senators and speak to people. and there was a process and maybe they. had questions that they wanted to be. answered and maybe some of them didn't.

love you maybe on the on a certain side. but you know you'd figure it out. That's. what you do. And you know, you have a. background where you worked for two. Supreme clerk for two Supreme Court. justices. You didn't come out of. nowhere. You know, your background was. such that you had the resume and. background and qualifications to be in. this job. It wasn't like you're a random. person who were picked for it. And you. know, and even if Republicans may not. have loved you in a Democratic. administration, they said, you know. what, we go back. This is the person who.

has the education, pedigree, experience. in this role. Like that's like that. that's who we get when we become in. power. If we have a Republican. president, the other side will live with. our pick provided they're qualified and. they have the same Harry type pedigree. and maybe on the other ideological side. of certain issues, but you follow the. law. You follow the, you know, you don't. go, well, I'm this, so here's how I'm. following it. So Harry, when you hear. cases like this, talk to us about it, especially given your experience. >> Yeah. So, it's a it's a really good.

point. The it's a very complicated set. of rules and the vacancy act and two. different statutes, but it's it's. basically simple. Congress, which under. the constitution has authority over in. to choose inferior officers, that's what. a US attorney is, wants to be in this. game, wants to have advice and consent. And uh every other administration has. played it square in that way. Just as.

you say, there are people that they. float for the job and they get turned. down fairly, unfairly, it doesn't. matter. Now it's time for another one. But it's a joint process. And the Trump. administration has been wanting to just. cut Congress out of the deal. And how. have they done that? They've put in. certain people. Each of these cases that. have come up uh Ben for for court. battles, every single one of which the. administration has lost are sorry to say.

it. Uh I know you like to say personal. opinion first amendment, but you were. talking hacks. So Sarone is someone who. has never had a day of prosecutorial. experience in his in his life. He's a. politically. uh connected Republican lawyer, has run. for different offices, etc. Trump wants him just like Trump wants. Lindsay Halagan, just like Trump wanted. Alina Haba. And the uh not just wants,

but they are apoplelectic. When when. they were first uh uh had to come up. against the facts of how the law works, they were ruthless. the the um if you go. a certain amount of time and you're you. haven't gotten somebody confirmed, the. court picks someone for a while to make. sure that things are running well. That. actually happened to uh me. I had been. nominated, but the process took a while.

and in the meantime, a very respected. Republican uh uh career uh prosecutor. was put in by the judges. But uh when. that happened here uh you've seen the. administration go to war and like fire. people right away. The ones who have. been put in uh and and the like. So, uh, what's going on here is just a complete. recitrance about the law that, you know,

this is the way it works. And you can't, as they've said in other areas, talk. unitary executive blah blah blah because. the constitution, as I say, reposes a. the a large measure of authority in the. congress. you can imagine, you know, just appointing uh Supreme Court. justices but bypassing the Congress. No, they want to have their role and they've. been uh ruthless has the administration.

and specifically in these cases. involving. uh people that they want to be in the. job like Lindseay Hagan, like John. Sarone, but who really have no business. being there. So, when the senators say, "Uh, uh, I don't think so." Uh, it's. just, uh, they've just been doubling. down there. But they've stopped. They in. each of these cases, they've seen. reason. And here's why. Um, you have. some, I mean, what essentially the.

second circuit held here is this guy's. an impostor. John Sarone. Yeah, call him. Mickey Mouse. It doesn't matter. He is. not the US attorney because he doesn't. pass muster. And that means the things. that happen under his authority are. voidable. So, here he is doing his good. uh Trump loyalist investigation into. Leticia James's office, also into uh a. investigation that they had against the.

um the the um rifle, you know, basically. gun owners and and that's of course. anathema for for team Trump. And so, um, they do it, but what happens is the. second circuit says, "Hey, guess what? You're not a real US attorney." And what. does that mean? We're quashing these. subpoenas. And if you keep going and. bring an indictment and it's signed by. John Sarone, US attorney, that could.

just as well have been uh signed by. Mickey Mouse. It's a non uh paper. The. same thing as with Lindsay Hallagan. So. here the courts ha really have a strong. uh card to play and they've been. basically uh winning when at first the. Trump administration tried all these. different maneuvers to just get around. the law and have the people they wanted. be indefinitely in the position uh.

without congressional. um o oversight or role in their. selection. So, um they they've basically. been been uh you know uh gotten gotten. theirs pretty good and are forced if. they want to just bring cases, any. cases, robbery, u gun violence, fraud. cases, you got to have a real US. attorney as as for whom the court does.

isn't going to say, "Oh, you don't. belong there." So, the whole case goes. away. I think you'll see this happen now. in the Northern District of New York. These subpoenas have been quashed. So. the whole um off office all all its work. that goes under the US attorney is. basically now worthless and they're. going to have to capitulate. They're. going to have to step to if they're. smart, they might try a compromised. candidate, but if not, and the court. puts somebody in, you know, they they've.

tried now to play hard ball, but they've. gotten uh beat up pretty good. And this. is, I think, the fourth time courts have. ruled against them, and they've got to. um change their tune, otherwise the. offices are just completely um. powerless. Harry, that's why I have you do these. videos with me. One, you know about. this. You're experienced in this. Number. two, you uh you clean up. I got so.

excited about the law that I forgot the. point of the order, which is that the. federal judges in the 2 to1 decision. I. I did tease it in the beginning, but I. always like to go into the weeds a. little bit, but that this purported. interim United States attorney was not a. real interim United States attorney. And. when we talk about Donald Trump's deals, they're never deals. They're concepts of. frameworks of sort of con concepts that. are never a real thing. His United. States attorneys are always concepts of.

United States, you know, attorneys. when he was doing the J6 slush fund, it. was a way to create a kangaroo court. system that was a concept of a court. where he could be the one to play judge. and jury and not have to deal with. things like evidence and not have to. deal with witnesses and you know and. it's why you know process matters. I. know Harry mighty bed heads um you know. process sometimes feels boring and.

frustrating and sometimes we don't want. to wait on the line. Sometimes we just. want to go on the ride without waiting. on the line. But guess what? If we all. just went on the ride at the same time. and didn't wait on the line, nobody. would get to go on the ride. And so I. understand, you know, lines and things. like that are easy to criticize and. attack, but process and order and. competence and diligence, these are. things that we used to care about and we.

care about here. And I think the line. example is apt. You know, you go into. Disney or you go into Universal, we'll. give California references. And it's of. course easy to look at the lines, right, and say, "I hate these lines. How dare. they do these lines. This is a pathetic. system and this is awful." But then when. you take over, nobody gets to do the. ride at all except you, in this case, Donald Trump. And now we all have to.

watch him do the rides and nobody gets. on it. But it was very easy to attack. the process. Very strange. >> I really love this this uh image, man. I. I traveled I've been in some. authoritarian countries and you're just. sitting there trying to get gas and here. come the big shots for whatever reason. they know uh the president and they just. cut the line. I mean these guys are. classic line cutters. It's really that. the line is there and Donald Trump. waddles in and gives a little hip check.

like he did in his first uh EU. conference. And man oh man, doesn't that. capture it morally? seeing seeing some. fat cat come in and cut the line. That's. who this administration believes it it. it can and itself to be. And I I really. that that gives a kind of visceral uh. reaction, doesn't it? And that's who we. got. >> This is it is I mean I think about what. he said on Friday where he said uh guess.

what? I did a deal. We're bringing in. massive amounts of beef from other. countries and it's going to be so cheap. 25% off. Then he was asked, "Which. countries? Who? Who'd you do this with? Who'd you do this with?" I'm not telling. you. I'm not telling you. You mean not. telling me? Okay. It's a monumental. secret. We never get to know. You know, it's just it's just at some level.
