WHOA: Far right judge pulls INSANE pro-Trump stunt in court
You're watching the Legal Breakdown. Glenn, the most pro-Trump judge in the. entire country is back in the news again. for yet again a bad reason. Can you. explain what just happened at the hands. of Judge Aileen Cannon? Brian, I hope. everybody's sitting down for this one. Judge Aileen Cannon just ruled in favor. of Donald [snorts] Trump. She ordered. that former special counsel Jack Smith's. report about Donald Trump's classified. documents crimes should remain sealed, secreted, hidden from public view, and I.
know that comes as a shock to everybody, but you know, it's not a shock to those. of us who have been following Judge. Aileen Cannon from day one. Let me kind. of unpack what this new ruling is all. about. So, you know, the prosecution. of Donald Trump and two of his indicted. co-conspirators, Walt Nauta and Carlos De Oliveira, you. know, these are guys who were like. running around hiding boxes of.
classified documents from the FBI and in. violation of a grand jury subpoena. requiring that they be returned to the. government. You know, these guys were. all all indicted together in a. conspiracy to obstruct justice. They. were indicted for mishandling classified. information. They were indicted on. violating our nation's espionage laws. I. mean, this was a deadly serious case. And of course, once it got into the. hands of Judge Aileen Cannon, she found.
a reason to dismiss it unlawfully. You know, our viewers should remember. that every single court case, every. single published precedent where. somebody tried to attack the legality of. the appointment of special counsel, or. even dating way back to the old. independent counsel, a prior incarnation. of the special counsel statute, every. single case said special counsel. perfectly lawful and constitutional, but.
then enter Aileen Cannon, biased, compromised judge that she is, appointed. by Donald Trump, got smacked down on. appeal twice by the 11th Circuit Court. of Appeals for doing what? Abusing her. judicial discretion and doing an. enormous favor that the law did not. allow for Donald Trump. So, we know what. she's been all about. So, what she did. is she basically lawlessly dismissed the. cases, threw them out against all three.
defendants saying, "Yeah, special. counsel's not really a thing, not not a. lawful vehicle to investigate or. prosecute somebody." Now, that that. ruling was appealed again up to the 11th. Circuit Court of Appeals and Brian, I'll. bet my full buck, that's my betting. limit, that the 11th Circuit Court of. Appeals would have reversed and returned. it to the trial court, probably to a new. judge because Aileen Cannon has. disqualified herself as being biased in. favor of Donald Trump. That case would.
have gone to trial, Donald Trump would. have been convicted in a New York. minute, or I guess in a Florida minute, and he would have been sentenced to. prison. That is where things should. stand right now, but of course, it was. not to be. So, here is some of the. aftermath. This is what we're dealing. with right now. Um. Trump and his co-defendants, former. co-defendants, Nauta and De Oliveira, asked Judge Aileen Cannon to please, please, please seal Jack Smith's report,
the special counsel report, mind you, that the law requires he author and. provide to the Attorney General, which. he did. They want it buried forever from. public view. In fact, two of the. defendants asked that she just destroy. it, which I don't know that a judge has. the lawful authority to order government. records destroyed. There are actually. federal laws requiring the preservation. of gov- government records. But be that. as it may, she's been sitting on this. litigation forever. For so long in fact.
that the 11th Circuit Court of Appeals. weighed in previously in some related. litigation that's going to be really. important because that's where we're. going to find the silver lining to this. most recent ruling. Um and the 11th. Circuit said, "Listen, you are unduly. sitting on this you're taking too long. Resolve this issue. Decide what you're. going to do." Well, today she decided. what she was going to do. She granted. Trump's motion and De Oliveira's motion.
and Nauta's motion to seal it, to. continue to hide it from public view. Why? Because it would be extraordinarily. damaging to Donald Trump. That's the. reasonable inference we can draw. And. and here is probably the most upsetting. part to this old prosecutor, and I think. it should upset anybody who cares about. the fairness of the criminal justice. system and the integrity of the. Department of Justice. Brian, we the people went entirely. unrepresented in this litigation, in the.
the litigation of this motion to keep. the report hidden. Why do I say that? Because Pam Bondi's Department of. Justice walked away from its. responsibility to represent the American. people. They crossed the bar and stood. shoulder-to-shoulder. with the formerly criminally indicted. defendants, Trump, Nauta, and De. Oliveira. Bondi was standing, figuratively speaking, right with them. saying what to the court? "We agree with.
Donald Trump. This This uh special. counsel's report shouldn't see the light. of day. We the people were entirely. unrepresented. in this litigation." So at the end of. the day, Brian, this was a foregone. conclusion. The fix was actually in and. today, you know, she made it official. by, you know, issuing a 15-page ruling. and I wouldn't urge anybody to read it. because it's garbage. Garbage in, garbage out. But, she decided to.
continue to keep this report hidden from. the American people. Glenn, the the I think most important. part of this is, okay, this is Judge Cannon doing what Judge. Cannon does, but what are the. implications now? Why Why did her. decision now help Donald Trump today? And before you answer that, I just want. to note for people that Glenn and I are. going to continue covering this and all. other legal news. Because people going to look at. this and they're going to say, well, you know, this is just another example. of the 2020 election uh being. re-litigated or not being re-litigated. So, why So, why does it matter? Here's. why it matters. We just saw in recent. weeks. former special counsel Jack Smith. testify before Congress and say things. like, "In my other criminal.
investigation of Donald Trump where he. was indicted for four felonies as part. of his attempt to steal the 2020. presidential election and to overthrow. it once he lost." And we got to hear. from Jack Smith some of the details. about how the the proof that they had. amassed during their investigation could. would easily have proved guilt beyond a. reasonable doubt if the case had made it. to trial. And he was able to share some. of the details of that evidence, not all.
of it because some of it was still grand. jury protected. Um and that was I think. some really important information for. the American people to see, you know, straight from the horse's mouth, Jack. Smith, who conducted the investigation. But he has been prohibited from talking. about the classified documents case. So. we don't know You know, we knew a lot of. what Donald Trump did to try to steal. the 2020 election. We knew about the. fake elector scheme that he and his. dirty lawyers orchestrated. We knew.
about his pressure campaign on the. the officials down in Georgia, right? Just find me 11,780 votes and corruptly. declare me the winner. I'm paraphrasing. here. We knew about him setting up the. pre-insurrection pep rally on the. ellipse on January 6th, come to DC, we'll be wild. And once he got the crowd. all riled up, he directed them to march. to the capital, fight like hell or you. won't have a country anymore. Now go. stop the certification of Joe Biden's. win, stop the steal. So we knew a lot of.
that evidence. What we don't know, Brian, is just how damaging to our national. security. Donald Trump's theft and unlawful. retention in violation of both a grand. jury subpoena, obstructing justice, and. in violation of our nation's espionage. laws because he unlawfully handled. what's called national defense. information. We don't know how much. damage he did or had the potential to do.
to our national security because all of. that has remained hidden from public. view. So yes, this has some very. concrete implications because it. continues to conceal Donald Trump's. crimes, you know, in violation of federal law. and crimes in a very real sense against. the American people and our security. And I would add to on top of that, and I. think that that all is is perfectly spot. on, is that Trump has been trying to use.
this supposed election fraud from 2020. as a pretext to shoehorn through his. efforts to undermine subsequent. elections. And if he allows or deigns to. allow Jack Smith's information to come. forward, which is that, you know, Trump. was actually in the wrong here, then. Trump loses his his basis, the. foundation to be able to say, "No, you're right. There there was all this. fraud, all of this illegal voting. Democrats were shipping in voters. Look, they they were sending in mail-in.
ballots that weren't being sent from. them. They were hoarding the votes. They. were doing late-night mail dumps." All. of this stuff relies on the actual truth. not breaking through. But if So So if. Jack Smith does that, that that screws. over Trump. But if if he can suppress. the truth. and allow his supporters to continue. believing the lies about the 2020. election, then he continues to have a. pretext to be able to lie about the 2026. and 2028 election. And we know, for. example, that right now he and. Republicans are trying to pass the SAVE. Act, which uh which would do away with.
mail-in voting. And again, the truth. would show that there is no widespread. fraud with mail-in voting. It's. something that Donald Trump himself uses. when he votes. Um and there have been. studies that show something like the the. rate of fraud in mail-in voting is like. 0.000001%. And uh and and so that would undermine. their ability to do this, to engage in. voter suppression. But But, you know, if. if they're able to win this narrative, then they believe that it still. continues to give them this uh this.
pretext that they need to push through. voter suppression efforts. Brian, this. whole thing by Trump and all of his. flunkies, his lapdogs, his sycophants, um this is an exercise in concealment. and deception. All designed, as you say, to allow him to keep, you know, spewing. these lies into the public square um. that run exactly contrary to what we now. know about what Donald Trump tried to do. to steal the 2020 election. Um but also,
you know, the classified documents case. and just how dead to rights Jack Smith. had him on the evidence. I mean, frankly, there is no such thing as a. sure guilty verdict in a criminal case. Take it from somebody who prosecuted. countless criminal cases over my 30. years as a prosecutor, but you know, based on the evidence that we did see, it looks like that one would have been. like shooting fish in a barrel and I. think a jury would have banged out. guilty verdicts just as quickly as the.
jury in New York banged out those 34. guilty verdicts on the felony charges up. there, literally in a New York minute. So, but you know what? Let let let's. just kind of turn to the silver lining. because this may end this piece of the. case. And again, I need to emphasize. that Pam Bondi and her Department of. Justice abdicated their role as. representing the interests of the. American people. I don't want to stray. too far from the topic, but this is the. same thing we saw up in New York when. then Deputy Attorney General Emil Bove.
abandoned his role as. a lawyer for the people, as an attorney. for the Department of Justice, and. crossed over and stood shoulder to. shoulder with what Trump wanted when. they were trying to dismiss the. prosecution against. Mayor Eric Adams for all of his fraud. and corruption. And remember, the judge. up there actually had to appoint an. independent prosecutor just to say, "Listen, somebody's got to represent the.
interests of the American people here. because, look, you know, the Department. of Justice has cozied up to the. defendant, Eric Adams." The same damn. thing just went on down in Florida in. this case. That's why it's not a. surprise that Aileen Cannon ruled the. way she did. But here's the good news. There is a separate lawsuit underway. It. has been underway for some time. It was. brought by an organization called the. night, not as in day and night, but as.
in knight in shining armor, the Knight. First Amendment Institute at Columbia. University. Is it any wonder Donald. Trump was trying to, you know, retaliate. against Columbia University previously. somewhat infamously? So, the Knight. First Amendment Institute in early 2025. brought a suit seeking the disclosure, the public disclosure of the classified. documents special counsel report as part.
of a First Amendment civil action to. access judicial records. Here's the good. news. Judge Cannon previously. refused to disclose, denied a motion to. disclose, and that is up at the 11th. Circuit Court of Appeals right now. And. remember, the 11th Circuit has twice. reversed Cannon in Trump cases, and they. said, "And you've been unduly sitting on.
these motions and ordering her to. resolve this motion to unseal special. counsel's report." That is in the. capable hands of the 11th Circuit Court. of Appeals. And Brian, I have a feeling. they're going to have a little something. to say about Judge Aileen Cannon's. steadfast refusal to order the. disclosure of the special counsel. report. So, that's the silver lining. There is still litigation underway, active, not in Aileen Cannon's hands,
but in the capable hands of the 11th. Circuit Court of Appeals judges. All. right.
