Trump pulls INSANE stunt in court, INSTANTLY FAILS

I'm joined now by All Rise News's Adam. Classfeld. Adam, we all watched the. bombshell development yesterday as. Kilmar Vera Garcia basically won out in. court against the Trump administration. Today, the Trump administration tried. something that is, in my opinion, completely lawless in the face of Kilmar. Vera Garcia's victory yesterday. Can you. explain what just happened? They tried to do it again, Brian. They. got an order saying that they had to. release him, uh that he had no final. order of removal, and they actually, in.

the first instance, released him from. immigration detention, but immediately. ran to an executive branch judge, what's. a so-called immigration judge within the. Department of Justice, to turn that 2019. order of removal that was, not, a judge. found, a final order of removal at all, and were retroactively declare it valid. that correcting a scrivener's error. And. they what they were going to do is, this.

very morning, have Kilmar Vera Garcia. check in to an ICE field office in. Baltimore and detain him again. So, Kilmar Vera Garcia's lawyers immediately. issued a motion for an emergency TRO, and Judge Zini's granted him long. granted that. Long story short, Brian, uh Kilmar Vera Garcia walked into that. Baltimore field office this morning, but. he walked right out to await trial back.

in his home. Adam, are you surprised. that, in the aftermath of the judge, Judge Zini's, ordering the release of. Kilmar Vera Garcia, and and it seeming. like there was finally a resolution as. far as, uh you know, his detainment is. concerned, that the first thing the. Trump administration tried to do within, you know, less than 24 hours was detain. him again? Yeah. You know, I I would have to say, Brian, it reminds me of our conversation. just yesterday. It doesn't surprise me. at all because what I said back then is.

I don't expect the Trump administration. to relent, and I didn't expect Kilmar. Vera Garcia's lawyers to relent, either. And that's exactly what happened, that. they went ahead the that you had Trump's. DOJ trying to find some excuse to hold. him for deportation immediately before. trial. And let's not lose sight of that. That they this is an end run around a. trial, but that effort was blocked just.

as quickly as it was tried. I want to. read a passage from Judge Zini's ruling. cuz she really gets to the heart of it. here. She says that the public, where it. retains keen interest in ensuring that. government agencies comply with court. orders, especially those who necessary. to protect individual liberties. She. says a little bit later in the. paragraph, for the public to have any. faith in the orderly administration of. justice, the court's and narrowly. crafted remedy cannot be so quickly and.

easily upended without further briefing. and consideration. So, she's just. telling the government right there, you. can't find some end run around my order. if the. if the public is going to have any faith. in the judiciary. And before that, she. points out that Kilmar Vera Garcia is. under. uh conditions of home confinement. So, the. that the her order is actually very. narrow. He's awaiting a trial. And if.

they cannot wait for him to defend. himself at trial at his home, then. there's then she's saying uh that sort. of thing won't leave the public with any. confidence in the justice system. Does. the fact that the Trump administration. tried to do this undermine their. existing case because, you know, there. is a world where the next step Kilmar. Vera Garcia takes is to is to claim in. court that he's being vindictively or. selectively prosecuted? And the fact.

that the administration seems so. hell-bent on not allowing this guy to. walk free for even a day of his life, doesn't that just kind of validate that. exact claim that we can expect Garcia's. lawyers to bring? Absolutely. The next hearing in this. long-delayed hearing in his criminal. case is on vindictive prosecution. >> And. doesn't this this exact um uh occurrence. lend itself to what his lawyers are. going to say in court? Absolutely, exhibit A, Your Honor. We.

had fought long and hard for months, nearly 4 months, to get him released. from immigration detention, and not even. a day into another federal judge. ordering his release, we try to find. some way to end run that order after. releasing him. At a certain point, it. gets to be absurd. At a certain point, it gets to be a combination of Groundhog. Day ver it combined with Kafka. But. here, there's a little bit of the happy. ending. It's you know, Bill Murray's.

nightmare is finally over, and he can. finally get the girl. At least for the. time being, he's back in Maryland, he's. back reunited with his family, and. there's a potential trial ahead if he. doesn't win his pending motion on. vindictive prosecution, where he's. already won round one. In terms of the. impending vindictive prosecution uh uh. uh case that he's trying to bring. forward, what judge is that going to be. in front of? Is that Judge Zini's as.

well? And do we know anything about, you. know, is there anything we can read from. the tea leaves in terms of the potential. success of that case? Yeah, so they're two separate tracks. This won't be before Judge Zini's, this. is before Judge Crenshaw over in the. Middle District of Tennessee. And what. we can read from it already, when I say. that Kilmar Vera Garcia's won won round. one, what I mean is the fact that. there's an evidentiary hearing at all is. good news for Kilmar Vera Garcia.

Criminal defendants do not get that as a. matter of course, those are hard to get. And because he has won the right to an. evidentiary hearing, the burden. shifts to the government. They have. what's now called the presumption of. vindictiveness, and they have to prove a. non-vindictive pur pur uh purpose for. this prosecution. And this hearing has. been delayed multiple times, seemingly. because the government is stonewalling. the discovery that it needs to share.

with the defense team for this hearing. So, the tea leaves there are. Kilmar Vera Garcia is in a very good. position after a major victory in his. civil case. I should note, too, that. Judge Crenshaw, it looks like, was. appointed by Barack Obama. So, in terms. of the draw, it could have been a lot. worse in terms of in terms of the judge. that that Kilmar Vera Garcia pulled. Absolutely. And as a matter of fact, these this is the same judge that.

granted his release on bond. That uh it. was originally his magistrate uh the. magistrate. uh released him on bond, that was. appealed to the district judge, and. Judge Crenshaw was the one who let him. uh. spend pre-trial release with his family. in the first instance. So, it's a good. draw, it's a good set of facts, but I. think even most importantly, Brian, there is the there is clear evidence on.

his side with vindictive prosecution, not only everything that we've been. seeing with the long long dream list of. faraway countries that they want to of. oh, we'll let you go to Costa Rica if. you plead guilty, or we'll send you to. Uganda if you don't, but also the fact. that high-ranking members of the. administration keep going out and. trashing him. And one of them, Todd. Blanche, went on TV and said that this.

investigation began this case began. because a judge questioned the DOJ's. decisions. And that goes right to the. heart of Kilmar Vera Garcia's vindictive. prosecution case, where he's saying he's. being targeted because he stood up for. himself, because he vindicated his. rights. And there's Todd Blanche saying. that to Laura Ingraham on Fox. To what. extent do you think that the relentless. focus on immigration is the direct.

result of this administration losing on. all of the other, you know, purported. focuses that they have, whether it's. whether it's, you know, the economy, inflation, the Epstein files, health. care. I mean, it has just been loss. after loss after loss for this White. House. Trump's own approval rating is a. reflection of exactly that. And so, do. you think that that is the reason that. this White House continues to double, triple, quadruple down on the. immigration stuff since historically, that's been where they're strongest? Well, I think part of the reason they're.

doubling down is they think that if they. vilify Kilmar Vera Garcia, uh that that. will be politically expedient. That will. be politically popular for them, and. that people won't care. People will. believe the worst. And that they think. that that's a political win. And it's. harder to tell the American public that. due process is important, that it's. central to freedom and the promise of. the United States. So, I think that is. why they go out in the court of public.

opinion and accuse him of things that. he's not charged with in court. I want. to repeat this because it always falls. by the wayside. He is charged with. smuggling. He's not charged with being a. member of MS-13. He's not charged with. any other offense but allegedly driving. immigrants across borders. And it's a. charge that would, on an average. sentence in that district, be a and a. day, but they're making him out like.

this grand. master criminal. Yeah. Um and so I think. that what makes them confident in. bringing this case is they hope, well, maybe people aren't going to pay. attention to the details. People are. going to think, oh, a judge stopped us. from deporting him and not a judge found. there was no valid order of removal. after we didn't take him up on his offer. to self-deport to Costa Rica because we. wanted to send him to more human rights.

abusers in countries where he doesn't. speak the language. That they think that. they can distract the public from. knowing the actual details about it if. they do that public campaign of. vilification. Well, look, I I I want to. let folks who are watching right now. know that there is no better authority. on this case in particular uh than Adam.
