I mean, normally if you have a Fifth Amendment. privilege, but you receive a pardon, the. pardon eliminates the privilege. And so, you're not in a position to be forced to. testify because you you know, if you in. normal circumstances, you can be forced. because you've been pardoned, you have. nothing to hide. >> I actually take issue with with what you.
said about about this idea that he. doesn't have the right to plead the. fifth here. The Supreme Court ruled in a. case called Ohio versus Reiner in 2001. that a defendant can plead the fifth if. there's a reasonable expectation that. they'll be exposed to criminal liability. even if they're innocent. And we know. that there is exposure the risk of. exposure to criminal liability even if. Anthony Fauci is innocent because Rand. Paul, for example, came out and said. that he is not going to rest until. Anthony Fauci is prosecuted. And this.
DOJ has shown that it's perfectly. willing to prosecute all of its enemies. It's done so or attempted to do so to. Jack Smith, Cassidy Hutchinson, Jerome. Powell, Letitia James, James Comey, John. Brennan, David Hearn, the six Democrats. who dared recite what the UCMJ said, and. even a guy who threw a subway sandwich. at a federal agent. None of those. prosecutions went forward, but that. doesn't mean the DOJ hadn't tried. So, of course Anthony Fauci is well within. his rights to plead the fifth because. there is very clearly exposure to. criminal liability even for somebody.

No judge worth his or her salt is. going to take a criminal referral from. this Department of Justice seriously. when all they've done is send a parade. of political opponents in front of. juries and judges only to see literally. all of them walk free. They have been. successful in zero vindictive. prosecutions. As I mentioned, that list. includes Jack Smith, Cassidy Hutchinson, Jerome Powell, Letitia James, James. But when you. squander every ounce of credibility that. you have trying to prosecute them every. week, not so much. And judges are. clearly wising up to that. So, going back. to Dr. Fauci, he was well within his. rights to plead the fifth knowing full. well that the Republicans would use. anything he said to try and prosecute. him. I mean, hell, they took him saying. nothing as justification to send over a. criminal referral. Meaning, either way, they were going to try and take him.
down, which I discussed with Glenn. Kirschner here. In a way, it's kind of. damned if you do, damned if you don't. because if he was going to go into. Congress and legally assert his Fifth. Amendment right um to to to not have to. answer any of these questions, they were going to and they did. move forward with a criminal prosecution. referral to the DOJ for what they claim. is a wrongful assertion of his Fifth. Amendment right. And if he did say. something, they would have found any. crumb to to hang their hat on and.
prosecuted him for that. So, either way, the fix was in and uh and it looks like. the Republicans had figured out a way. that they could get a criminal referral. over to the DOJ whether he spoke or he. didn't. >> You're exactly right. I mean, he could. have been asked, "You know, what color. sport coat were you wearing on the day. you learned about the COVID epidemic?". He said, "I think it was blue." Well, no, it was actually dark blue. Perjury. I mean, it's a it's a ridiculous. example, but nothing is too ridiculous. for the, you know, the this dirty DOJ. >> So, that raises the obvious question. If.
this is a doomed effort, why would why. would Republicans focus so much energy. and attention on it? And the answer is. that they have nothing else. What else. could they possibly run on? The economy. is in the toilet, job growth is anemic. if not negative, inflation's rising, gas. is surging, prices are through the roof. across every sector, we're spending. billions of dollars on a war that Trump. promised would never happen, and the. entire Republican Party, except for. maybe two people, are engaged in a. pedophile cover-up. Of course, they have.
to run a 2020 redux and try and turn. Anthony Fauci into the biggest news item. of the day. If they didn't, they might. actually have to run on their record and. think about what a disaster that would. be. And when I pressed Pavlovic and Trusty. on that point, I was hit with talking. points about how we must hold Anthony. Fauci to account for what he did. After. all, how can we forget about those. things? First of all, it's so funny to me how. Anthony Fauci is to blame for all of the. problems during COVID when Donald Trump,
the President of the United States, turned the White House press briefing. room into his own personal reality TV. show for the better part of a year. offering up pseudo science and straight. And that, according to. Republicans, was totally fine. He bears. none of the blame. Told people to inject. disinfectant, A-OK. But the guy who. dared suggest that we wear masks is a. criminal. Get real. If a Democratic. president suggested injecting. disinfectant, you would be calling for. the electric chair. But because it's.
Trump, he gets a pass because the buck. never stops with this president. Desperate to consolidate all this power, but doesn't want an ounce of. accountability when he actually uses it. Convenient, huh? Also, if Anthony Fauci is responsible. for all COVID deaths, then by that same. logic, is RFK Jr. not responsible for. the Cyclospora outbreak or the measles. outbreak right now? Measles are at their. highest point in modern US history, with. more cases this year already than the. entirety of last year, which at that.
point was also the highest point in. modern US history. So, by Katie. Pavlich's logic, RFK should be. prosecuted, right? And does Trump bear. no responsibility in appointing him, despite knowing full well that he was an. anti-science quack? I asked that. question to Katie Pavlich, and of. course, she pivots to, who else. but immigrants. You see, measles isn't. RFK's or Trump's fault, despite. dismantling our healthcare system, it's. coming in from across the border. Always. the fault of some brown person.
somewhere. Trump could, as he said, shoot someone. on Fifth Avenue, and these right-wing. sycophants would figure out some way to. blame a migrant caravan 5,000 miles. away. So, look, my job on this show was not to. convince anybody on that panel. Both the. host and her guest are Trump sycophants. to the nth degree. But I go on that show. to offer up facts to the audience and. expose the lies that they feed their. viewers on a daily basis. And if I can. change even one person's mind by. explaining the truth about a Fauci. criminal referral or the hypocrisy.
surrounding Republicans blaming Fauci. but not RFK, then I I like I've done my. job. And I know that there is a lot of. concern over platforming people or. validating other people's platforms. Look, these people exist. Their. platforms exist. Pretending that they. don't gets us nowhere. I'd rather try. and do my part to talk some sense into. their audience than seed those spaces. entirely. And yes, I will get ganged up. on, I'll get railroaded, and sometimes I. even get threatened to be muted on. national television. I won't stop.
