SHOCK UPDATE: Justice Department dealt NIGHTMARE NEWS
Some unprecedented bad news for Trump's. DOJ. In their effort to see sensitive. voter registration data from the states. so that they can do with it what they. want, they have now lost their 12th case. in a row to Marc Elias's law firm. In. other words, Trump has sued 12 different. states to steal their voter data and. lost in literally all of them. The. latest loss comes in New York where. Trump had attempted to gain access to. the state's unredacted statewide voter. registration list. And what's worse, each loss makes it more difficult for. Trump to win the subsequent case because.
now judges are beginning to cite losses. in previous cases as part of the. justification to deal Trump losses in. these cases. For example, according to. Democracy Docket, the judge in this. latest New York case wrote, "This court. joins every district court to have. addressed this issue in concluding that. a voter registration list is not a. record or paper that a state must. produce to the government. It has long. been recognized that the elections. clause entrusts the administration of. federal elections to the states." All of. which is a point that Marc Elias himself. reiterated here. >> Each time Donald Trump's administration.
loses in court, does it become more. difficult in their subsequent case? Like. is there some degree of atmospheric. precedent where a judge, even though. it's not binding precedent, can say, "Well, look, the DOJ has already lost. nine of these cases based on XYZ. principles. I also agree with with, you. know, the the what the judges ruled in. those other cases and so that's going. to, you know, if not binding, but at. least atmospherically impact how the. next judge is going to rule.". >> Oh, absolutely. I mean, I there's no.
question. And and you know, when there. are new decisions in courts, we we make. sure that the other judges are aware of. them. So, the judges are all aware of. how the other the first nine judges have. ruled, how the first nine cases have. gone. And and given the ideological. breadth of of the judges who have all. ruled in our favor. And and again, these. are not just some Trump judges. I mean, a number of these are extremely. conservative um judges appointed by. Donald Trump. And so, there's just like.
across the ideological spectrum, across. the geographical spectrum, there has. just been a unanimity around this. And. so, I can tell you as someone who has. followed the courts that have not yet. ruled, you know, the districts where the. judges have heard arguments but haven't. yet ruled, DOJ's in for a rough stretch. >> Now, while this is the 12th loss for the. DOJ, it is by no means the last. According to democracy.dockit, in the. lower courts, the DOJ now stands at 0. and 12 in the 31 voter roll lawsuits it. has brought against the states and DC as.
judges from across the ideological. spectrum, including many nominated by. Trump in his first term, have ruled. against the department's legal theories. There are 31 voter roll lawsuits. And if. the first 12 are any indication, they're. in for a rude awakening in the next 19. Now, I do want to take this opportunity. to note that these cases are possible. because of a 501c3 that Marc Elias runs. called the Free Election Fund. That is. the entity that funds this crucial. pro-democracy election litigation. Now, I've promised to donate the proceeds of.
my upcoming book, The Day After, to this. entity because I think it's important to. fund this absolutely critical voting. rights litigation. But, this promotion. is only for the pre-order period, which. ends today. So, if you'd like to support. my work and support Marc's work, today. is the last day to make your book. purchase count toward this litigation. I'm going to put a link to pre-order. right here on the screen and in the post. description and in the comments. Or, you. can simply go to. briantylercohen.com/book. Here's Marc Elias explaining that point.
>> Brian, I have to take a second here to. thank you because you have written a. book which I am proud to have written. the forward for, about what comes after the Trump. administration, assuming Democrats. retake power. And you have been kind. enough, along with your editor and your. publisher, to make a donation to help. support the exact litigation in these. cases, but also frankly the litigation. that supports. a lot of what we talk about on this.
series. So, if anyone out there was on. the fence as to whether or not to read. Brian's new book, which like I said I. wrote the forward for it, so I think. it's a great book. I think it's really. important that you read, but if you're. on the fence, do it because it will also. be a way that you can help financially. support the litigation that we are. talking about today, and frankly the. litigation we usually are talking about. in this series. >> And look, like Mark, I have dedicated my. entire life to fighting these. anti-democratic forces. And while I've. spent the last year of my life writing. this book, I felt that it was important.
to not just talk the talk about fighting. fascism, but walk the walk. So, if my. writing can simultaneously help fund the. litigation and the attorneys who are on. the front lines of this battle, then. that is objectively a good thing. So, again, a reminder that today is the last. day where orders for The Day After will. count toward my donation to the free. election fund. So, you can grab a copy. of The Day After by going to the link in. the post description to. briantylercohen.com/book, or you can find it anywhere books are. sold. And I'll also be on tour July 14th.
in Washington, D.C., July 15th in New. York, and July 18th in Los Angeles. So, if you want to support me in person, where I'll be signing books and doing an. hour-long talk with different guests, there are still tickets available and. you can find tickets at the same link as. before, briantylercohen.com/book. Thanks so much. >> [music]. >> Before you go, I'm very excited to. announce that I've written a new book. titled The Day After: How to wield power. in a post-Trump world. The book explores. what is, in my opinion, the single most.
important theme that we're dealing with. in politics today and moving forward, power. Specifically, how Republicans. abuse it and how Democrats refuse to. wield it. This book explains how we got. here and more importantly, how we should. finally wield power if we're fortunate. enough to get it back. It is the. blueprint for progressives who want to. do far more than just restore the status. quo. Please pre-order today by visiting. the link in the episode description or. go to briantylercohen.com/book. You can grab yours from any of the major. retailers like Amazon or Barnes & Noble.
or find an independent bookstore closest. to you. That's also listed on that. website. Thanks so much for supporting. independent media.
