Justice Department makes STUNNING announcement about the FBI

The DOJ has just made a pretty shocking. announcement as it relates to certain. FBI officials and their execution of a. search warrant back in 2022 of Mara. Lago. Glenn, can you explain what's. happening now at the hands of the DOJ? >> Brian, it's amazing how this story can. simultaneously. be outrageous and infuriating. and yet more of the same. What we've. come to expect from Donald Trump and his. dirty DOJ officials. So, we all know. that Donald Trump was being criminally. prosecuted in not one but two federal.

cases when he won re-election. The. classified documents case at Mara Lago, which more precisely was a conspiracy to. obstruct justice. It was obstruction of. justice for defying a grand jury. subpoena to return the damn documents. that he had in substance stolen, highly. classified documents. There were. espionage charges because some of these. documents contained what the law calls. national defense information. Those are.

crimes that fall under the Espionage Act. in our criminal code and more charges. So, he was being prosecuted in that case. actively. He was also being prosecuted. for four felony counts for which he'd. been indicted in connection with the. January 6th attack on the capital and. his attempt to unlawfully retain the. power of the presidency. Of course, he. got reelected. So both of those cases. had to be dismissed by special counsel. Jack Smith. So now, Brian, what Donald. Trump is trying to do is somehow undo.

all of that history, undo the fact that. an investigation was conducted, that the. evidence was presented to a federal. judge, that the federal judge found. there was probable cause to believe. Donald Trump had evidence of those. classified documents, crimes on his. property at Mara Lago. Lo and behold, when that search warrant was executed, what did we find? national security. documents, classified documents that. Donald Trump had improperly taken from.

the federal government and moved down to. his resort in Florida and he was. indicted for it. There was intense. litigation. Now, people may remember. that unqualified hack judge Ailen. Cannon, a Trump appointee, dismissed it, but that was actively on appeal. And. I'll bet my full $1 max bet that the. 11th Circuit Court of Appeals. undoubtedly would have reversed the. dismissal and sent it back for trial. Listen, Donald Trump knows that because.

that case was dismissed by Jack Smith. without prejudice, which are magic. words, because that means the minute he. leaves office, he can be reindicted and. that case can be put back on the trial. track, more precisely the appellet track. before the 11th Circuit Court of. Appeals. So he is trying to do. everything he can to try to undo it. nefariously, not in accordance with the. law, not in accordance with the. evidence, really contrary to to all of. the evidence that we saw publicly.

reported that we saw filed in that case. as it was moving its way through the. system. So he knows that's a real danger. zone for him the minute he leaves. office. So now here we go. We've got to. investigate the investigators. We've got. to try to undo and undermine the. investigation that led to his criminal. indictment and prosecution which got. shortcircuited. So, does it surprise me? No. Is it outrageous? Does it turn on. its head the entire notion of following.

the facts wherever they may lead and. applying the law? That's exa exactly. what Jack Smith did. Of course, it. offends that notion. But here we go. again with Donald Trump trying to save. his own criminal ass. Just a quick note for those who are. watching right now. this has, which is to say uh the. chilling effect that it presents here? Because if you have any prosecutors who. are even considering working on. something where Donald Trump or his. acolytes can ultimately have some say in. things, think about what's going to. happen to those people. Does does the. chilling effect of taking aim at any. prosecutors who are involved in anything. anti-Donald Trump have some uh place in. all of this as far as they're concerned? >> You know, Brian, this is searingly.

corrosive to the operation of law. enforcement. That goes for the FBI. It. goes to the federal prosecutors, both at. Maine justice, the Department of. Justice, and at all 93 of the United. States Attorney's offices around the. country and in the territories. Because. just think of it, if they're assigned a. case involving a criminal president of. the United States, including a criminal. cabinet member or a criminal member of. Congress who is ends up being affiliated. with the party that comes into power.

Are they not going to be thinking to. themselves, I've seen this movie before. when we work cases against political. people, powerful people, influential. people, connected people, and the next. administration wants to take its. revenge, not because we did anything. wrong. We actually followed the facts. and the law, but they want to take take. revenge on us because of politics, because they're from the other party. Um, why in the world would I stay in.

government, use my experience, my. expertise that I've gained to put myself. in that position only to be unfairly. retaliated against in the future. You. know, I come to believe this more every. day, Brian. This is Donald Trump's goal. to destroy the legitimacy and the. perceived legitimacy of every. institution of government. And he just. wants to rule over the whole mess. And. and I have to tell you, if there's one. thing that I think he has accomplished.

in life, and I don't believe he has. accomplished much, it is the destruction. of the institutions of our government, courtesy of a largely complicit. Republican party that is just letting. him do it. >> What about the protections that these. FBI agents have? I mean, they've Look, it I don't think it's lost on anybody. that these people did nothing wrong by. investigating and prosecuting somebody. who was ultimately indicted and would. have been found would have been.

convicted uh if these investigations had. been allowed to run course. That's. literally their job. And so what. protections do these FBI agents have. because now they are the subject of. what I would call a corrupt prosecution. into them for the crime of doing their. own jobs. Well, they should have civil. service protections, but we know the. Trump administration has blown through. all of the statutory and procedural. protections that FBI agents, DOJ.

employees have under, you know, civil. service laws. They they just don't care. about it. Now, there are many FBI agents. who are suing the federal government for. wrongful termination, for retaliation, for simply doing their job. So, it's. little comfort, kind of cold comfort to. say, well, you know, there are these. civil service laws protecting their. rights. Well, the Trump administration. doesn't give a rat's ass about the laws. that protect the people that they want. to seek revenge against. Now, of course,

the other rights they have are under our. Constitution. for example, they're going. to have a right to be represented by. counsel when you know the FBI cash. Patel's FBI comes a calling saying, "All. right, we want to talk to you about the. fact that you participated into an. investigation involving the the. president of the United States." They. will be able to potentially invoke their. fifth amendment right against. self-inccrimination if they are called. upon to testify before a grand jury, for. example. Um because you know we know the.

Supreme Court has said listen if if. there are circumstances where you could. be entrapped or ins snared or your. statements could reasonably be used. against you given what the federal. government has been trying to do. Well, you know what? The the fifth amendment. against selfinccrimination uh applies. and protects not only the guilty person. but the innocent person. And we've seen. that play out recently in other cases, in other settings, and with respect to. other people like Anthony Fouchy. So,

you know, they're going to have some. protections, but you know, if the Trump. administration wants to make their lives. miserable, make them you hire lawyers, make them spend not only a lot of money, but spend a lot of sleep sleepless. nights for themselves and their family. That is exactly what the Trump. administration is going to do. But, you. know, we've seen instances where this. federal government and the law. enforcement agencies have become so. corrupt under the Trump administration. that they are losing good investigators. and prosecutors and agents to state.

departments that are actually willing to. do their jobs. There was a good example. of that. I think there were six federal. agents who left uh the DOJ or the US. attorney's office in in in Minneapolis. or Minnesota somewhere out there and. instead went to work for the state-run. agency because they weren't willing to. to to do anything as it relates to the. killings of Renee Good and Alex Prey. And so uh maybe this will be a situation. where we have you know FBI agents who. are getting targeted for the crime of.

having done their job and the federal. government may ultimately lose those. people to state agencies that will. actually do the work of bringing about. uh some accountability for what the. federal government itself is doing. >> Yeah. If there's a little bit of a. silver lining sort of lurking behind. this big orange dark cloud, it it's that. people across all of the institutions of. the federal government have left. Something like uh approaching I think. half a million f federal government. employees have left been wrongfully. terminated, been fired, and they're.

going to state governments. Where are. they going? They're going to states. attorney's office, counties attorney's. offices, commonwealth attorney's. offices. They're going to state attorney. general's offices. And they are. populating the state governments with. good experienced former federal. prosecutors, former federal law. enforcement agents and officers like. from the FBI and other agencies, ATF, DEA, and others. That's a real, I think, benefit to the various states. And let's.

face it, the states also have a fight on. their hands right now. Many of them are. defending against their own federal. government who's trying to interfere in. their state operations in any number of. ways. most directly these days in. voting. So, you know, I I think if there. is any silver lining to all of the. people who have been fired or the mass. exodus from the federal government, so. many of them are landing in the state. governments. And that over the long run. will prove to be a good thing. And and. by the way, they're landing there with. bad blood between the federal government.

and them. And so they have every. incentive in the world to say, "Hey, not. only have I left my job, but I've left. my job because these people wronged me. for the crime of doing my job." And so. if there's an opportunity to have to. investigate some of what Trump is doing, these people are going to be uh in a. situation where they're going to want to. redouble their efforts to do exactly. that because they've personally been. wronged by the people who caused them to. lose their jobs in the federal. government. Yeah, I would think being. unlawfully, you know, kicked out of your.

job would be a pretty powerful. motivator. But here's what I will say. That's human nature and I don't think. you can sort of, you know, pull that out. of human beings. But what I will say is. I think these people will still. understand that they need to go about. their work as state prosecutors, state. law enforcement agents apolitically. Oh. sure, aggressively but they need to. follow the facts, apply the law, divorce. politics and their personal experience. out of whatever the work is that they.

are pursuing and you know do it the way. it has to be done which is apolitically. which is the way that I and my friends. my former colleagues did our work as. career prosecutors for the 30 years that. that I was a federal prosecutor.
