🚨 Feud ERUPTS between judge & Trump team as Trump MOCKS court order

You're watching the legal breakdown. Glenn, in our last episode, we talked. about a big ruling handed down from a. judge where the judge ruled that the. Trump administration had to return uh a. migrant who was wrongly deported due to. an administrative error to a prison, a. maximum security prison in El Salvador. The Trump administration has responded. saying, and I'll put the tweet right. here on the screen, we suggest the judge. contact President Boule because we are. unaware of the judge having jurisdiction. or authority over the country of El. Salvador. So basically this White House. is saying that they are perfectly.

content to wrongly deport people legal. residents from this country, but once it. comes time to actually get them back. here, well, you know, our hands are. tied. There's nothing we can do. Can you. speak on that on on the legality of what. they're seeking to do here, which is. just to basically uh have no claim that. they have no jurisdiction once they. wrongly deport someone out of this. country? Yeah, Brian, get ready for the. bouncing ball of injustice. Three quick. data points. One, a judge issued an. order prohibiting the United States. government from deporting Mr. Garcia.

back to El Salvador. Two, the US. government did it anyway. They said, "Whoops, it was an administrative. error." I'm not buying the. administrative error line, but that is. the explanation they're offering in. court. But Brian, they are acknowledging. that there was a lawful order. prohibiting the government from. deporting him to El Salvador. and. they're claiming, whoops, they did it. anyway. But it was an administrative. error. And here comes data point number.

three. The US government, the Department. of Justice said it is quote not possible. for the US government to get Garcia back. from El Salvador. And here is the. horrific line in a brand new pleading. that was filed today by the Department. of Justice. They said that, you know, the judge is commanding us, the. defendants, the US government to do. something that we have no independent. authority to do. Make El Salvador.

release ourgo Garcia and send him to. America. Brian, that right there is some. banana republic And I'm not. referring to El Salvador. We, the United. States, are the banana republic. When. these, they say we can just unlawfully. snatch up stuff into a plane and send to. prisons in foreign countries. Not just. anybody, but people who not only don't.

deserve to go to those countries, but. somebody who the court has ordered we. may not deport to those countries. But. we strike a deal with that with El. Salvador. We say you house these people. You imprison these people that we're. sending your way. And then even when. they admit they were wrong for doing it. in the first place, they say, "We don't. have the authority to tell the El. Salvadoran government to open the prison. door for this one wrongfully deported.

individual, give him back to the United. States so we can comply with a court. order and return him to the United. States." I mean, again, if that's not. some banana republic stuff, I don't know. what it is. Glenn, what I guess what I'm. having trouble wrapping my head around. is for the DOJ to fight this. I mean, imagine fighting to keep a guy who is. wrongfully detained in an El Salvadoran. goolog in El Salvador. Like, why why. would the tack they take be, okay, we've.

we've admitted that we were wrong, but. now our goal is to is to do nothing. when we certainly could do. I mean, all. they have to do is pick up the phone and. and call Boule and and it's done. And. so, so why fight for something that that. that there's no basis for? Why fight to. keep somebody who is not guilty in a. prison anywhere, much less in a foreign. country? Brian, it doesn't make sense to. you. It doesn't make sense to me. It. probably doesn't make sense to our.

viewers because this doesn't seem to be. the deportation hill on which our. government should be looking to die. They should say, "Listen, we've already. acknowledged we made a mistake. Let's. get this guy back. However, we're going. to keep deporting people we think are. dangerous." And I think that would put. the the Department of Justice, the. federal government on better footing. with the courts. But I don't think they. care about that. I think this is a naked. power grab. I think the executive branch. is flexing here and maybe even testing.

the, you know, defying court orders. water and they're going to see how far. they can go. Um, this is a stupid fight. for them to pick. But it seems to me. they are that we are fastly approaching. a place where Donald Trump's executive. branch, which I maintain is being run. like a criminal enterprise out of the. Oval Office, um they want to see just. how far they can push the federal courts. and the federal judges because I fear.

that when it when it comes to. intentionally defying court orders, you. know, they may just be getting warmed. up. Glenn, to add insult to injury here, I'm. going to put a tweet of the El Salvador. and President Naib Bukay's uh response. to all of this up on the screen. This is. a gif of a confused bunny in response to. the court order that this non gang. member be returned to this country. What. do you make of the fact that the. president of El Salvador is now. basically joining up with the Trump.

administration in effectively mocking. our own legal system? Yeah. So, first of. all, what world diplomacy by cartoon. gifts? That strikes me as wrong for lots. of reasons, Brian, but it it strikes me. as especially wrong when what we're. dealing with here is human beings that. the United States deported wrongfully, it looks like for the most part, and not. just Mr. Garcia. But there are uh. restraining orders and preliminary. rulings from other courts that the Trump.

administration likely. unconstitutionally sent a whole bunch of. Venezuelan immigrants to that El. Salvadoran prison which is sort of. notorious for you know using torture. among other things on the inmates. Um, so how callous can you get when you're, you know, sending, you know, amusing. cartoon memes and gifts when you're. dealing with the lives of human beings, many of which have been treated.

unconstitutionally by our government, the United States. Now, I understand why. the president of El Salvador would put. up something that conveyed his confusion. like, "Well, wait a minute. We agreed. with the Trump administration that we. would house these, you know, people that. they were deporting from the United. States. We would stick them in our. terrorist goolog." And now the Trump. administration is telling federal court. judges that they don't even have the.

ability to ask us to return somebody who. they admit was wrongfully deported and. is wrongfully being confined in our. prison in El Salvador. Brian, none of. this makes a lick of sense. Right. Completely agree, Glenn. Now, in terms. of what the DOJ is doing, they're. seeking an administrative stay of of. this ruling by the judge. Uh, is it the. judge's own prerogative whether to. whether to grant this stay? And. presumably the judge isn't going to. grant this stay because if she already.

ordered that Garcia be returned, I don't. imagine that she's going to be um too. too um too differential to a Trump. administration that is seeking to just. not return this person. Yeah. So, let's. sort of touch the procedural bases now. Where do we go from here? So, first of. all, sometimes trial court judges will. issue a ruling and they will give the. parties a brief 3-day, 5day, 10day stay. for purposes of seeking appellet review. That's not all that unusual. But, as you.

say, when time is of the essence and. when, as the judge notes, Garcia's life. might very well be in danger. She said. there is an urgency to having him. returned after he's been wrongfully. deported. um she may not grant the. motion for a stay. So an administrative. stay just means don't actually make us. comply with your order to return Garcia. by 11:59 p.m. on April 7th, which were. the terms of her order. Um give us a. minute to file an appeal of your order.

with the Federal Circuit Court of. Appeals and argue our case. So, we'll. see if the judge grants the admin a. brief administrative stay. But if she. doesn't, what will happen is they will. then file in the federal circuit court. of appeals and seek a stay from that. court, the appeals court, a stay of the. trial court, the lower court's ruling. So, all of this is going to come to a. head literally within the next probably. 48 hours or so. And of course, the. question then becomes, and we spoke. about this a little bit in our previous.

episode, but for folks who are just. tuning in now, what happens in the event. that the Trump administration just. declines to abide by the court ruling. and doesn't return Garcia by the 11:59. p.m. deadline on April 7th? Yeah. Then. what we're going to see is a process. that is unfolding in federal district. court in Washington DC in the uh. Venezuelan immigrant unconstitutional. deportation case where Judge Boseberg in. DC has moved in the direction of.

contempt of court for the Trump. administration having um potentially um. intentionally defied his court orders. I. think you will see the same process. begin to kick off in this Maryland case. in federal court. And you know, if I. were the judge, I would say fine. Now, I. am ordering every Trump administration. official who had their fingerprints on. this unlawful deportation and refusal to. comply with my orders to bring Mr. Garcia back. I'm going to issue an order.

that you show cause as to why you should. not be held in contempt. And let's. remember, Brian, we talk a lot about. contempt. We haven't made our way there. yet, but we're getting closer every day. And the sanction for contempt can. include up to a period of confinement in. jail. So, you know, there is still a lot. for these administration officials to. lose if a court finds that they. willfully defied court orders. And. finally, Glenn, look, I I know that our. job here isn't to predict the future.

It's just to explain what's going on in. a way that's accurate and honest. But if. I if you had to put your put your dollar. bet on the line, do you presume that. that the Trump administration is taking. steps to comply with the court's order. and get Garcia returned to the US by the. deadline? I would like to say yes, but. my gut tells me no. My gut tells me this. is a flex. This is a play for a power. grab by the executive branch. The right. thing to do, as we discussed a few. minutes ago, would say, "Judge, you know.

what? Give us a little bit more time. We're going to make arrangements to have. Mr. Garcia brought back." That would be. the responsible, lawful, and. constitutional thing to do. But it seems. like Donald Trump and his administration. want to be neither responsible nor. lawful nor quite frankly constitutional. All they want is to grab up grab up more. power for themselves. So, I fear we're. going to see this this battle come to a. head. Now, Glenn, if that 11:59 p.m. deadline on April 7th comes and goes and.

Gar Garcia still has not been returned, what happens next? Does the judge call. the DOJ into the courtroom at 7:00 a.m. the next morning? Yeah, good question. Right now, it depends on how she acts on. the motion for the administrative stay. because if she grants it, then they're. going to have a few more days, a little. bit more time to work this through. If. she denies it, that is a sure sign that. she is expecting that the government, the administration will comply with the. order and bring him back at 11:59, no. later than 11:59 p.m. on the 7th. And if.

they don't, I suspect the next minute, midnight, you're probably going to see. an order entered on the docket, what's. called the minute order on the public. docket that I am uh directing the. attorneys to arrive in court tomorrow. morning when court opens at 9:30 and. we're going to be talking about why you. failed to comply with my order. And then. we're going to be talking about. potential contempt. All right. Well, we. will of course stay on top of this.
