Brian Tyler Cohen on SUING Donald Trump

I made a video yesterday bringing you. behind the curtain on what happened to. me when Donald Trump targeted me by. putting me on his enemies list. I spoke. about the harassment, the fishing. campaigns, the hacking attempts, and the. death threats. Nothing that I'm a. stranger to after having worked in this. space for a decade, but certainly ramped. up a huge degree when the president of. the United States decides to use his. platform to target me by name. And the. number one question that I got was, "Why. don't you sue Donald Trump?" So, let's. go through that answer because there are. a few different layers to this. First of.

all, the government has a free speech. right in the same way that you or I have. free speech rights. So, their decision. to include me on an enemies list on. whitehouse.gov, while ridiculous, and. I'll get to that in a moment, is still. likely within their rights in the First. Amendment. Now, I could make an. argument, a political argument, that. their focus on attacking a YouTuber is a. testament to just how backwards this. White House's priorities are. That with. sky-high prices, rising inflation, surging gas prices, a raging new war in.

the Middle East, and hidden Epstein. files, that it might just be a better. use of their time to do less targeting. of content creators and more, you know, governing. And while that's not a legal. argument, I think it's a really potent. political argument. It is hard for these. people to make the case that they care. about regular Americans when all of. those problems exist and yet they are. dedicating resources to publishing. enemies lists online. But, back to the. prospect of a lawsuit, one avenue that I. could explore is the argument that.

Trump's inclusion of me on this list is. putting me in danger, putting my life in. danger, that it's resulted in increased. harassment and death threats, hacking. attempts, all of which is true. And I. might have a case on that point, but. that brings me to the second part of the. story, the cost, financial, mental, and. emotional. It is not cheap to file a lawsuit. against the federal government. It is. not easy to file a lawsuit against the. federal government. Generally, these. things are not done on contingency, meaning you only pay if you collect. damages. Meaning I would have to shell.

out tens or more likely hundreds of. thousands of dollars if I actually want. to fight this thing. And the government. knows that. They know that there's such. a high barrier to getting this done, which is why they do it so freely and. openly. It's why they've tried to. prosecute everyone from Jack Smith to. Cassidy Hutchinson, Jerome Powell, Letitia James, James Comey, John. Brennan, David Hearn, the six Democrats. who dared recite what the UCMJ said, even a guy who threw a subway sandwich. at a federal agent. Not because they've. got a case on the merits, they don't,

and literally all of those prosecutions. failed. It's because there is still a. cost to defending yourself when you're. innocent. And that cost is enough to. make a massive financial, mental, and. emotional toll on someone. So, where does that leave me? The harassment will continue, the cyber. attacks will continue, and the death. threats, I'm sure, will continue. But, here's how I win. I don't let this White. House do the exact thing that they're. trying to do, which is to get me to sit.
