BREAKING: Trump dealt EMBARRASSING LOSS in federal court

I'm joined now by Adam Classfeld from. All Rise News who just left federal. court in conquered New Hampshire. Adam, we have a major ruling that was just. handed down. Can you explain what. happened in court? What happened is a federal judge has. blocked Trump's birthright citizenship. ban with a classwide application to all. babies who might be affected by it. You. might remember, Brian, uh toward the end. of the Supreme Court's term, it. delivered a stunning ruling that had all. but abolished nationwide injunctions.

But in that decision, it had allowed. federal judges to continue uh blocking. things with a classwide application. Uh. so it did not rule on the merits of. Trump's birthright citizenship ban which. every judge who has heard this case has. decided violates the plain meaning of. the 14th amendment. Uh the first line of. the 14th amendment guarantees birthright. citizenship and every court including. this one has said that's not a close.

call. That's an exact quote from this. judge uh Judge Joseph Leland. He said. it's just not a close call to the court. The open question before today is can an. unconstitutional order be blocked by a. federal judge in anything beyond the. jurisdiction of that court? Could it. have gone beyond the district of New. Hampshire, the District of Maryland? Would we have states across the country.

litigating this? And meanwhile, more. than a 100,000. babies uh potentially stateless, being. unable to claim uh food stamps or. Medicaid benefits uh in the wake of the. Supreme Court's decision. This morning, a federal judge answered loudly, basically saying that one, this is. unconstitutional and will be blocked, but two, that a class can be certified.

to encompass all babies nationwide. And. so, this is going to be a ruling that's. going to be quickly appealed, of course. But as it stands right now, a federal. judge has said yes, the Trump's. birthright citizenship ban can be. blocked with a universal application. So. obviously, Adam, it was a cataclysmic. event when the Supreme Court came out. and said that nationwide injunctions. were unlawful. But is there any.

practical difference here between a. nationwide injunction and a judge saying. that the entire class of newborn babies. who would fall under this category that. would be affected by birthright. citizenship? Is there any practical. difference between the two since really. there's just the entire class of babies. that are born that would fall under this. this umbrella of birthright citizenship. are now protected? The short answer is no. As a matter of. fact, this judge, you know, there had. been multiple judges across the country. that had blocked birthright citizenship.

ban, the Trump executive order on a. nationwide basis. This judge initially. wasn't one of them. He was one of the. skeptics about nationwide injunctions. He said today, "Class actions are. different. There aren't geographic. limitations on it." So, the effect of. this judge's order is that this is in. effect a nationwide injunction. It. blocks the application of Trump's. executive order against all babies. There is not an exception in that. Uh he.

is going to issue a written ruling. explaining the details and the nuances. of his decision. But this is a. categorical win for the ACLU and other. uh uh lawyers who brought this case. It's a big win for the immigrant. community here in conquered New. Hampshire. Uh, this case is Barbara V. Trump, named after an H and Honduran uh, woman who is about to give birth in. October to a baby that she was worried.

would be rendered stateless if this uh, birthright citizenship ban took effect. on July 27th. Would that have ever happened before? Like would we have ever seen babies born. in the United States of America in our. 250 plus year history that that were. rendered stateless upon birth? You know this the right the. constitutional right to birthright. citizenship was forged in the ashes of. the civil war uh the 14th amendment.

ratified uh the protections of. birthright citizenship and subsequently. uh protected by statute this judge said. So, we're talking about over 125 years. of precedent of the Supreme Court. litigating this very issue and the. Supreme Court finding that that. birthright citizenship had protected. anybody born in the United States. Now, the Trump administration has this.

radical reinterpretation of a phrase in. the 14th Amendment subject to the. jurisdiction of the United States. I I'm. not sure about you, Brian, but but I I. think that we're in agreement here. Subject to the jurisdiction, if if. immigrants aren't subject to the. jurisdiction of the United States, how. could you prosecute someone? How could. they be subject to any laws? Uh this is. not this is a radical interpretation.

that has never been accepted for more. than a century. And that's why judges. that have reached the merits on this. issue have swatted it down again and. again and again. And it happened again. this morning. Isn't that what the Trump. administration is seeking though for for. im for any immigrants not to be subject. to the jurisdiction of the United States. and therefore they also wouldn't be um. they wouldn't be afforded due process. I. mean this is what the Trump. administration specifically Steven. Miller is looking to do. They they want. to deprive uh birthright citizenship to.

immigrants. They want to deprive the. laws of the United States to these. immigrants. They want to deprive due. process to these immigrants. I mean, isn't this one small part of a larger. hole? Oh, absolutely. And it's not for nothing. that this is a day one executive order. from Trump on inauguration day. One of. the first things he did was try to ban. birthright citizenship. And after the. Supreme Court's order, there was a very. interesting exchange today. Uh that I'll. tell you about two very interesting.

exchanges. One was from the ACLU's. lawyer. The ACLU's lawyer said in court. that uh since the Supreme Court had. reigned in nationwide injunctions, they. had been getting panic phone calls from. uh members of the immigrant community. wondering what are they going to do? They're confused. They're they're. concerned. They don't know if their. babies are going to be born stateless. they don't know whether they should move. to another state if their state does not.

block the uh the birthright citizenship. ban locally. So that's one point that I. wanted to uh really hammer home the. amount of panic in communities in New. Hampshire and all around the country. The other point, there was an very. interesting exchange between the. government and the judge where the. government started talking about uh how. Donald Trump framed this issue. protecting the value of US citizenship.

And so the uh the Justice Department. attorney Eric Hamilton had said. something to the effect of it's the. greatest privilege of in the world. And. the judge replied, I agree. And he also. pointed out that the attorney had used. the word privilege rather than right. because it's a right protected by the. 14th amendment. Um he also said because. it is such a privilege because it is. such a privilege. Isn't that irreparable. harm? Now irreparable harm is the.

standard for the legal standard to issue. an injunction. and he returned to that. while issuing this ruling, rejecting. this kind of radical reinterpretation, this project that you pointed out, uh, Brian, this day one project to redefine. what citizenship is, and to push people. outside of that zone of citizenship, render them stateless, and deprive them. of their rights. Um, and so it was a.

categorical ruling from this judge. rejecting that. And again, he said it's. just not a close call to the court. Now, given the fact that it's inevitable. the Trump administration is going to. appeal this, does the fact that we have. this ruling, notwithstanding the fact. that it's a ruling handed down by a. judge who was a skeptic, but does the. fact that we have this ruling have some. atmospheric impact on what an appeals. court might say? You know, it's very interesting because.

remember when the Trump administration. appealed the injunctions that preceded. this to the Supreme Court, they didn't. say, uh, justices, this executive order is completely. constitutional. They didn't say, uh, you. know, Chief Justice Roberts, this is a. totally lawful order. They said, they. came forward with this challenge of. nationwide injunctions. And now here's a. judge who kind of agrees with the. government on nationwide injunctions,

but deeply disagrees with the government. when it comes to the uh the lawfulness. and constitutionality of this order. And. he took a look at the rigors of class. certification and said, "Yes, this class. of all babies who would be affected by. this order, that passes muster." Yeah, that could be very persuasive to the. courts when it goes up uh on appeal. Remember, no court has said the. birthright citizenship ban is hunky.

dory. None of them said that the 14th. amendment suddenly doesn't apply or. subject to the jurisdiction has this. novel radical fringe interpretation. uh that is now the central holding that. had the government chose specifically. not to litigate this on the merits. uh. that merits ruling will eventually come. Um and it seems to be the ruling that. the government has been avoiding. Okay. Well, Adam, thank you for uh for.
