BREAKING: Judge drops BOMB on Justice Department

I'm joined now by All Rise News' Adam. Classfeld. Adam, we have major news that. involves Trump's DOJ where it seems that. the fate of thousands of cases is now. put at risk. Can you explain what just. happened here? >> Absolutely, Brian. What happened is. after Alina Habba was disqualified as. the US Attorney for the District of New. Jersey, Trump's DOJ had a choice. They. could try to replace her in an in a. constitutional way, in a legal way, and. allow the Senate to confirm someone. who's qualified. Or they could allow the.

court to appoint someone who is. qualified. That's not what the Trump DOJ. did. What the Trump DOJ did is that they. appointed what a federal judge called a. triumvirate of special attorneys. And. none of those three people, a federal. judge just found, was legitimately. appointed. And the judge, Judge Matthew. Brann, issued a very clear warning. saying that if you continue to insist on. bringing cases through these attorneys,

I'm going to start dismissing cases. And. he put it this way in the ruling, uh. pointing out that there were lots of. legitimate avenues for them to appoint. the right people. With all these options remaining, why. does the fate of thousands of criminal. prosecutions in this district. potentially rest on the legitimacy of an. unprecedented and Byzantine leadership. structure? The government tells us the. president doesn't like that he cannot.

simply appoint whoever he wants. Notwithstanding the chaos that pervades. criminal prosecutions in this district. and without regard to the possibility. that scores of dangerous criminals could. have their cases dismissed or their. convictions reversed, the executive. branch, at least for now, is not. prepared to use the legal options. So, this is what it boils down to because. Trump wants to dictate who is at the top.

of these districts, thousands of cases. are at risk and a judge is saying the. case thousands of cases that judges in. the District of New Jersey preside over. can be dismissed. >> So, basically, I mean, this is what. Trump could see coming because we know. that that he has been hell-bent on kind. of appointing these uh lackeys as his US. attorneys across the country only. because they would be willing to do his. bidding. But, these people weren't going.

to get the support of the districts that. they represent and so they were being. ousted and yet Trump seemed hell-bent on. making sure that they could stay in. these positions illegitimately. But, now. the judges are basically saying, "Okay, if you want these people to stay in. these positions illegitimately, you can. go ahead and do so. But, that means that. any cases they they bring forward and. any prosecutions they sign their names. on will be thrown out because they. shouldn't be in their positions in the. first place.". >> Absolutely. And we saw that happen last. year in the cases of James Comey and.

Letitia James. In those cases, it just. happened to be that those cases were. illegitimate. But, what the judge is. saying is you're throwing the entire. dockets into turmoil and this was. eminently foreseeable. People have seen. for months now that in the District of. New Jersey where this particular ruling. is taking focus, there had been trials. that were postponed, sentences that were. postponed, juries not being sworn in. because federal judges were saying,

"Well, we can have this trial now, but. it could be entirely voided and because. of double jeopardy, if these cases are. dismissed, these defendants can't be. prosecuted again and all because Trump. is insisting on unconstitutionally. appointed and illegally appointed people. being at the top." Well, the interesting. thing is I I know people are going to. say this and say why doesn't Trump just. get rid of these people and put. different people in their positions. because if he wants these prosecutions.

to go forward then the the least he can. do, the bare minimum is to make sure. that he has legitimately appointed US. attorneys. But the problem for him is. that any US attorney who could actually. get approved to be in that position is. not going to sign their name on the. byline of these indictments. And so this. really is a catch a catch-22 because on. one hand these hacks that he has. improperly appointed are the only ones. that are going to do his bidding and on. the other hand, if he has a US attorney. whose appointment could actually be. legitimate, they're not going to sign.

their names on these hack prosecutions. And so what is the guy really to do if. his sole goal here is to push forward, you know, these these selective or. vindictive prosecutions against his. enemies? >> And you really hit the nail on the head. of the problem here. The only people. willing to push ahead the prosecutions. like the prosecution against Letitia. James and James Comey are prosecutors. who are under Trump's thumb essentially. It was Lindsey Halligans. It wasn't.

anyone else in the Eastern District of. Virginia. In the Northern District of. New York where they tried to go after. Letitia James yet again it was through. another illegally appointed, unconstitutionally appointed US attorney. John Sarcone. And where this is heading. is after being repeatedly slapped down. by the trial courts and now by the. appellate courts the Trump DOJ is. digging in. And you see people like Todd. Blanche uh attacking judges who are.

insisting that the law and the. Constitution be followed. And this is. Judge Berman saying there are going to. be real world consequences of that. There going to be thousands of cases in. utter turmoil. and what you see the. Trump DOJ doing is increasingly bizarre. and creative workarounds. Like, think. about the weirdness of what happened. here, Brian. Instead of replacing Alina.

Habba with a legitimate US attorney, Pam. Bondi appointed three different people. You had one person who is handling the. criminal cases, one person who is. handling the civil cases, and other. person handling the administrative. cases. All of them called special. attorneys because I think they have this. strained legal rationale that will let. them end run the law that makes it so. that Trump can't just simply dictate who.

has these roles, and that you have. democratic small d buy-in from the. senators who need to say, "Yes, this. person is qualified." Or, "No, this. person is not qualified." And what this. judge is saying in an scoriating. 130-page. ruling is that it's, you know, it's go. time. If they do if they keep doing. this, they're going to see these cases. dismissed. >> I mean, at the at this point, like, I understand.

that I had just asked about the fact. that you need to find some US attorney. who's going to do what Trump wants to. do. Like, his sole priority is finding. some hack sycophant who's just going to. carry out his unlawful or abusive. edicts. But, the reality is it's clear. at this point that with the prosecutors. that he has in place, that's just not. going to happen. And so, doesn't he have. a vested interest in finding somebody. else to put in these positions who could. actually get approved to to serve as. these US attorneys if he wants anything.

to go through? Or, do you think that. Trump's priority is going to be. stubbornly digging in his heels and then. trying to end run around these judges. through some other way? Like, is there. there It doesn't seem to me that there. would be some appeal process to make. sure that if a judge throws out, you. know, an unlawfully appointed. prosecutor's indictment, that there's. some higher authority he can appeal to. Is that correct? >> Well, there are ongoing appeals. Now, it's very clear that the appeal that.

made it to the intermediate court right. now, the third circuit, failed. And it. wasn't close. It was a unanimous. decision. There's another one for the. fourth circuit. I assume it's going to. go way. And I think even this Supreme. Court, which Trump might be banking on, maybe they'll say, "Well, you know, maybe they got to balance the ledgers. after tariffs." But that this is just. such a clear-cut. flouting of the appointments clause of. the US Constitution, of federal law, and.

when they're seeing what Trump is doing, that this the the purpose of this these. constitutional violations and these. violations of the law. isn't uh some sort of technical matter. He's doing it to persecute his enemies. That this is a losing battle, but one. that I expect they're going to dig in uh. all the way until they feel real. consequences. And we'll see once these.

cases start getting reversed because of. these constitutional violations, once as. Judge Brand puts it, dangerous criminals. have to be released onto the streets, what will be the political fallout of. that? Will you know, Trump is almost. certainly going to start attacking them. as activist judges making you unsafe, but can uh the actual facts of the. matter penetrate to the public. discourse? That this is happening. This. is the.

result and end product of refusing to. follow the law and have these. prosecutions be legitimate and be. led by constitutionally. legally legitimate actors. And of. course, the ultimate irony of that is. that if and when Trump does exactly what. you're saying because I think that's. exactly what's going to happen. Uh that. the irony will be that this is a guy. who's responsible for, you know, allowing 1,600 violent insurrectionists.

to storm onto the streets, many of whom. went on to commit further crimes, even. crimes against children. And so, you're. going to have somebody who is. responsible for the fact that his US. Attorney's indictments won't be able to. hold, that those will be thrown out, that violent criminals will be allowed. back onto the streets, which was. completely. uh uh foreseeable and completely. preventable. And he'll use that to frame. himself as the victim at the hands of. these activist judges. And that he's. some champion for law and order when.

he's also the same guy who has already. made the conscious decision to allow. criminals to to pour into the streets as. the direct result of his pardons. So, again, it's just a kind of hypocrisy on. top of hypocrisy, shamelessness on top. of shamelessness, but. what what do you really expect from this. administration?
