BOMBSHELL: Trump attorneys now facing DISBARMENT
You're watching the Legal Breakdown, Glenn. We have got a bombshell ruling. from a federal judge related to Donald. Trump's lawsuit against his own IRS for. $10 billion. and then the subsequent $1.776 billion. slush fund. So, what just happened in. federal court in Florida? >> Well, Brian, if any legal development. can accurately be called a blockbuster. development, here it is. A federal judge. down in Florida, Judge Katherine. Williams, just ruled that Donald Trump.
brought a bogus lawsuit to, quote, manipulate the judicial process. Close. quote. You know, this is the kind of. thing that I don't think we've ever seen. a federal judge say about a president of. the United States. He brought a bogus. lawsuit to manipulate the judicial. process, basically to enrich himself and. to bestow upon himself and his family. members immunity from tax audits and by. extension tax prosecutions. I mean, talk.
about the legal upside down in which. we're living, but the good news is Judge. Williams just called it out in a 56-page. order that I am still working my way. through, but let's take the viewers. back. How did we get here? So, first of. all, Donald Trump decided to sue. Donald Trump himself, his own. government, his IRS, which he controls. completely and exclusively. So, Brian,
in a very real sense, Donald Trump sued. himself. And what did he demand? He. wanted to give himself $10 billion. of our taxpayer money from the US. Treasury, and he brought this legal suit. to kind of give this bogus. patina, this sheen of legitimacy, because, look, I filed a lawsuit, therefore, I must be entitled to money, right? I have been aggrieved. So, he.
sued himself. And Brian, the DOJ never. even bothered responding to the suit, never filed a reply, never filed a. single shred of paper. And I think the. suit was in existence in the federal. courts for 109 days, is I believe the. number the judge Williams cited. And. then Donald Trump dismisses his own suit. that was brought against him. His IRS. that he controls. Remember, he said, and. the Supreme Court has backed them up on. this, that Article 2 of the Constitution.
means he can do anything he wants. He's. a de facto king, including doing. anything he wants with the IRS, with the. US Treasury, and with the Department of. Justice. So, can you see how it is that. Donald Trump is literally suing himself? Then what did Donald Trump decide after. 109 days when the case was dismissed? He. dismissed it. He decided that he was going to have his. DOJ, his acting Attorney General Todd. Blanche, whom he controls fully as if.
Todd Blanche were a puppet on strings. that were being held by Donald Trump, he's going to have Todd Blanche set up a. weaponization fund. Let's call it what. it is. It's a cop beaters fund because. the intent was to pay out the people who. attacked the US Capitol, beat police. officers nearly to death, and stopped. the certification of Donald Trump's loss. in a presidential election. Fortunately, they got it back on track and the. rightful winner was actually uh.
confirmed as the winner, Joe Biden, and. he became president. He wanted to pay. our tax dollars to the tune of 1.8. billion to the cop beaters. So, that's. why I call it a cop beaters fund. Now, mind you, Donald Trump is both parties. here. He's the plaintiff, he's the. defendant, he's negotiating with. himself, as he said, this settlement. 1.8 billion plus he said, "Wait, I want. more. I'm going to settle with myself. and I'm going to bestow upon myself.
immunity from ever being audited by the. IRS and by extension ever being. prosecuted by the IRS in the event an. audit would disclose that, you know, I. had committed some tax crimes, but not. just me. I want to give that immunity to. my family members and my businesses as. well." I mean, the level of depravity. and insanity and just runaway. lawlessness is really hard to put into. words, but you know, the judge, Judge. Williams, did her best to put it into.
words in that 56-page ruling and she. said, "This is an outright manipulation. There were no no two parties in this. case with adversarial positions. It was. all Donald Trump and you cannot collude. like that. You cannot use the judicial. system for nefarious purposes." And. Judge Williams went a step further, a. couple of steps further. She said, "Donald Trump's two lawyers who were. involved in bringing this lawsuit, one. needs to be referred to the Florida. State Bar for an ethics investigation.
and possible sanctions. Another one, by. the way, is prohibited from even working. in this court system as a lawyer for, I. believe, a 1-year period." She also. mentioned that Todd Blanche and others. at the Department of Justice very likely. should be investigated for their. potentially unethical conduct and. complicity and collusion in all of this. So, like I say, Brian, if ever the word. blockbuster fit for a legal development,

to it because this is a really big part. of this whole story. >> Yeah, so as I just mentioned, Judge. Williams did a couple of things on the. lawyer disciplinary front. First, one of. Donald Trump's lawyers will be referred. to the Florida State Bar. Now, you and I. have discussed the Florida State Bar. previously when, for example, Pam Bondi. had been referred to the Florida State. Bar for her unethical conduct when she. was Attorney General. And what happened? Well, while she was still Attorney. General, the Florida State Bar said,
"Well, you know, regardless of what kind. of unethical conduct she may have. engaged in, we've got this rule down. here in Florida where we will not. actively investigate a constitutionally. appointed officer like an Attorney. General. I think that is bar council. insanity. Why? Because there's nobody. that it it's actually more important to. investigate in real time, in a timely. fashion, than an unethical Attorney.
General who's doing the bidding of dear. leader in the Oval Office, not. representing the interests of the. American people, which an Attorney. General is sworn is obligated to. represent. But that is the rule in. Florida, no investigation of a. constitutionally appointed officer. So, the good news on that front is, well, guess what? Pam Bondi ain't a. constitutionally appointed officer. anymore. So, we're we're hoping. everybody, I think, is hoping, people. who care about the rule of law and. justice and holding unethical attorneys.
accountable is hoping that Florida. actually is now engaged in an ethics. investigation of Pam Bondi. And in fact, new complaints have rolled in. There's. been reporting about that against Pam. Bondi since she left the position of. Attorney General. >> [snorts]. >> So, um it it seems like the one attorney. that brought this suit, this, you know, bogus, manipulative, collusive lawsuit. on behalf of Donald Trump is being. referred to Bar Counsel. I would like to think that Bar Counsel.
will do its job honestly, ethically, and. apolitically, and aggressively, and will. take the judge's findings deadly. seriously with respect to the misconduct. by this attorney. And another attorney. has been barred from actually practicing. in that federal jurisdiction for a year. So, listen, all we can do is hope that. the Florida State Bar Counsel, um that. will take up this investigation, this. referral from Judge Williams, of one of. Trump's attorneys, will take it.
seriously, will move out expeditiously, fairly, apolitically, and based on the. evidence. And it's impossible, impossible for this old career. prosecutor to conclude that he will be. exonerated of all wrongdoing. I suspect. he will be found to have engaged in. unethical conduct exactly as Judge. Williams found or suggested. And the. sanction, I think the only appropriate. sanction is permanent disbarment for. this kind of, you know, horrific ethical.
breach. So, let's uh let's let's keep an. eye on it, and let's hope the Florida. State Bar Counsel is up to the task. >> Glenn, is there a way for Trump to. appeal this so that it can fall into the. lap of another higher-up judge who's. perhaps more sympathetic to his cause? >> Brian, that's a good question, for which. I might not have a good answer. And. here's why I say this. Remember, this lawsuit had already been. dismissed, but then there were a number. of people who intervened, who filed um a. request that the court actually look.
into whether this was a collusive. lawsuit, a manipulative lawsuit, a. corrupt lawsuit that was just designed. to sort of give this sheen, right? This. patina, which is a word that the judge. actually uses in her. in her ruling, just just thin veneer of. plausibility. When you scratch beneath. that patina, you see the corruption. right there. So, what the judge did when. these other parties sought to intervene. and filed a motion to have her look into. whether this was a collusive lawsuit,
and I think it included many, many, many. retired federal judges, and Judge. Williams took that deadly seriously. She. litigated it, and she asked DOJ, and she. asked Trump's attorneys to respond to. these very severe allegations. There. were some responses that were filed. They were not entirely satisfactory. And. here is how Judge Williams actually. concludes her 56-page. order. She says, "In sum, the facts before this court demonstrate.
there was never adverseness between the. parties." I'll translate that in a. minute. "There was never a case or. controversy, and there was never a. question as to who would prevail.". What's the judge saying there? She said, "These two parties, Donald. Trump and Donald Trump." Of course, it. was the IRS was the alleged organization. that Donald Trump was suing, but he is. the IRS by his own admission. He.
controls it, and he even said, "Now I'm. negotiating a settlement with myself.". So, there was no adverseness. Why is. that important? Because for the federal. courts to have jurisdiction, have the. lawful authority to entertain a lawsuit, the parties have to be adverse to one. another. They have to be bumping heads. They have to want different things. But. here, there is only one party in. substance, Donald Trump, and you can't. bring a lawsuit against yourself, and. you can't settle a lawsuit that you. brought against yourself, and you can't. give American taxpayer money to yourself.
when you settle that lawsuit. She said. one, there is no adverseness. Two, there. is no case or controversy. The. Constitution itself, Brian, and you. know, there are Supreme Court justices. who have spent their careers trying to. persuade us, dupe us, I would say, into. believing that they're textualists. We. abide by the text of the Constitution. Well, the Constitution says there has to be a. case or controversy in order for the.
federal courts to have the authority, the jurisdiction to handle that suit, that case. And the judge says, "There is. no case or controversy here. This is a. fraud. This is a sham. This is. manipulative. This is collusive.". So, without a case or controversy, there. is no lawsuit, period. And then the last. thing she said, which was kind of. poetic, is. there was never any doubt who was going. to win. Because when Donald Trump sues. himself, guess who wins? Donald Trump.
wins. And he wins at the expense of. taxpayers. He takes 1.8 billion dollars of our. money and directs it as he chooses, paying off copywriters. He bestows upon. himself immunity from tax audits and his. family and his businesses, which by. extension and inference means he's never. going to be prosecuted, and he can. commit all the damn tax crimes he wants. with impunity and immunity. The judge.
said, "No, period. Done." And she said, "It is so ordered." What does that mean? That was the longest run-up ever to. answering your question. I don't think there's anything to be. appealed here, Brian. The The case was. dismissed. There is no pending case. Are. they going to appeal the fact that this. case was dismissed and these findings. were entered? And what? They want to. re-bring a collusive case? They want to. reverse the fact that the case was. dismissed. They will very likely file.
some kind of a bogus appeal saying, "We're appealing all of this language, and we're appealing her referral to bar. council of one of Donald Trump's. lawyers, and we're appealing this, and. we're appealing that.". There is no case or controversy. There's. nothing to appeal. There is simply a. finding and an order by the court, and. the court has some authority and. responsibility to kind of police the. parties when they believe a fraud has. been perpetrated on the court. They. don't just have to sit back and accept.
the fraud by Trump and company and say, "Thank you, Mr. President. Can we have. another?" No. So, I don't know that. technically there is something to be. appealed that an appellate court the. circuit court of appeals over that that. jurisdiction, I believe it's the 11th. Circuit. is going to have anything to to resolve. Um. so, it's a really interesting question. I suspect you will see lots of ranting. and raving by Donald Trump, probably, you know, on his little social media. platform. You will probably see strongly.
worded statements issued by the White. House, and maybe even by Todd Blanche, who knows. Um but I don't know that. there's a legal issue or ruling to be. appealed. Well, we'll have to stay tuned. and see what we hear about that in the. coming days. >> Glenn, in your estimation, is there any. way that this thing can end up in front. of the Supreme Court, which is obviously. where Trump wants it to go? >> Well, you know, Brian, given that I. don't really think there is much here to. appeal to the court of appeals, which. would be the next stop on the appellate. ladder,
I find it really hard to believe that it. would go from there up to the Supreme. Court. Now, that doesn't mean that if. Trump's lawyers file an appeal and the. circuit the circuit court of appeals. says, "No, nothing here for us to. actually decide, so denied. Go away.". Donald Trump could try to bubble it up. to the the Court. I I tend to think. that's unlikely, but given Donald Trump. and the people who represent him, including Todd Blanche, who fully. represents Donald Trump, let's not kid.
ourselves, and you know, suggest that. that Todd Blanche represents the. interests of the American people. I. mean, he's involved in a collusive. settlement by which he was ready to. empty out the US Treasury of tax money. and give it to Donald Trump to control. and give away as he sees fit. Insanity. Um so, I think it's not terribly likely. that this thing will make its way up to. to the Supreme Court in any way. >> You know, this strikes me as perhaps the. most egregious corrupt action he's. taking, you know, thus far, trying to.
literally just pay himself $10 billion. from the US Treasury. Because frankly, if this is allowed, then what's to stop. him from taking $50 billion or $100. billion? So, did it strike you that way? >> Does it strike me that way? Yes. Next question. Okay, let me put a little. meat on the bones. I agree with you that if this is. allowed, a collusive, manip-. manipulative, corrupt lawsuit to be.
brought by Donald Trump against Donald. Trump, Donald Trump as president against. Donald Trump as head of the IRS or any. other federal agency for that matter, and that Donald Trump can negotiate and. settle with himself for whatever, you. know, billion number he chooses to put. on it, as you say, 100 billion. That's a. nice round figure. And he can literally. just say, "I need you to back the trucks. up to Fort Knox." I don't know if that's. really where all of our assets, our. cash, our gold bars are held, but, you.
know, I've seen the Bugs Bunny. commercials where they come out of Fort. Knox with a burlap sack with a big black. dollar sign on it. So, at least. figuratively, Donald Trump telling his. officials, "Just back up the truck to. Fort Knox, unload all of the US assets, all of the taxpayer money, and deliver. it to me, my family members, my friends, my criminal associates, maybe the J6. attackers, who knows. And yes, I think. if we allow this manipulation of the. judicial process, using Judge Williams'.
words, to stand, the corrupt sky is the limit. >> After hearing from this judge in. Florida, do you still think that the. judicial system is largely holding up as. a bullwark against Trump's worst. excesses? >> You know, Brian, I actually do think the. federal bench continues to hold strong. for the most part because trial court. judges, that is the first level of the. the federal judiciary, trial court judges from coast to coast. have been ruling against Donald Trump. consistently and vigorously in some.
really scorched earth language. I wish. there were some contempt citations. I'm. hoping that they come in the future. Um. but these are judges who are appointed. as far back as as by President Jimmy. Carter. I think that's the earliest um. judicial appointment with with one or. more judges still on the bench, still. ruling against Donald Trump. And judges. appointed by Ronald Reagan and George. H.W. Bush and George W. Bush and Donald. Trump himself. Obviously, I'm running. through the uh the roster of Republican.
presidents. And the federal bench continues to hold. strong against Donald Trump's. dictatorial zeal, his autocratic. efforts. And you know, I continue to. have faith and confidence in the trial. court judges with some outliers like. Aileen Cannon, who's not a really. legitimate actor or a a fair broker of. the rule of law. And and the circuit courts of appeals. appeals are also for the most part. holding strong. The wild card is always. going to be the Supreme Court, right?
You've got a handful of ideologues who. have decided to abandon the text of the. Constitution in favor of doing, you. know, ruling in a way that that pleases. Donald Trump and expands his power. beyond all constitutional constraint. contrary to the text of the. Constitution. But for the most part the federal bench. is holding strong. They are providing. the kind of check and balance a check. against executive branch overreach,
abuse, corruption, outright crime, unconstitutionality. that we need if we are going to survive. as a republic. And let's leave it with a. point of light. I was heartened very. heartened by the Supreme Court not. letting Donald Trump cross out a. constitutional guarantee from the US. Constitution birthright citizenship. Six. justices even though Kavanaugh waffled a. little bit. 6 to 3 was the vote saying, you know. what sport you don't get to cross out.
constitutional guarantees with your. black sharpie. So yes, the courts are. holding strong and I hope we see more of. that and I hope we see the Supreme Court. continuing to stand up to Donald Trump's. excesses, his lawlessness, and his. unconstitutionality. >> All right.
