Also breaking tonight, was there a plot for a terror. attack at the Mall of America?

Tonight the suspect now under arrest after allegedly buying. an AK-47 and 200 rounds of ammunition from the FBI. Here's our Chief Justice correspondent, Pierre Thomas. Sheikh Doon Mohammed arrested yesterday. after authorities say he purchased an AK-47 and. 200 rounds of ammunition from an FBI agent posing.

David, the FBI says the young man picked October 24th. because that arts festival would have had quote. a lot of people. Pierre Thomas live at Washington, Pierre, thank you. Tonight in Tennessee, the death row inmate and. that botched execution. A week later, as doctors were preparing to declare.

her brain dead, she woke up. Tonight we have learned what her first words were. and what is the plan now. Will the state try again? What her lawyers are now fighting for tonight. Here's Faith Abubey. Tonight, lawyers for Krista Pike, the convicted murderer. who survived two attempts by the state of Tennessee to. execute her, say she's awake, angry, and confused. She felt the burn of the pentobarbital. And then she woke up in a hospital surrounded by people. she didn't know with a tube down her throat. Pike's lawyers say doctors believed she was brain dead and.

were making final preparations. [Music]. >> I'm so excited to be here.

David, thanks. And there are so many questions that need to be answered, not by Krista, but by the state of Tennessee. And David, Pike's lawyers are pushing for the governor to. commune her death sentence to life in prison.

The state's attorney said today there's no pending. order to execute her. Now whether there is a new order issued is up to the. Tennessee Supreme Court. Faith Abubey with us here tonight. Faith, thank you. Tonight there's news in the Cornell case. One of the fraternity members who is still on campus. His attorney tonight saying his client believes Jane Doe was. coherent and able to make her own decisions. So just moments ago, our Aaron Katersky with the. alleged victim's attorney asking for reaction. to those words. Here's Aaron again tonight. Tonight with growing protests at Cornell University,

we're hearing from an attorney for Jilio Lopes, one of the fraternity brothers, Jane Doe is accused of rape, who is still a student on and the campus. There was no evidence whatsoever that Julio. had non-consensual sex. Loebs' lawyer addressing claims Jane Doe was incapacitated by. drugs and alcohol that night. To him, her affect was such that she was coherent and. capable of making a decision.

And she was an active and engaged participant in. their sexual encounter. Loeb's is one of two students who were suspended, but. he is still on campus. In this video circulated on social media, Loeb's. is confronted on camera when the news broke. about Jane Doe's lawsuit. Are you not like embarrassed to be here? Loeb's grilled about Snapchat group messages. shared among nearly 60 fraternity brothers, inviting them to the bedroom during the alleged assault. Everyone in Cornell is ashamed of you. Like, that group chat is disgusting.

I had nothing to do with that. Were you in the group chat? Chi Chi activists? There's 60 people. Yeah, and none of you did. [BLEEP]. I believe Giglio is a good young man. and comes from a good family. And I think he deserves an opportunity. to finish his education without being intimidated, threatened, harassed, or terrified. Tonight we asked Jane Doe's attorney about Jillio Lopes'. recollection of that night. I want to get your reaction to something one of the defense.

attorneys just told us from Mr. Lopes, the defendant. He said to him her effect was such that she was coherent and. capable of making a decision and she was an active and. engaged participant in their sexual encounter. Well, that's completely contradictory and contradicted. by the independent people who are not affiliated with these. men who said she was completely, grossly, invisibly intoxicated. Obviously, what are they going to say?

It was consensual. Big deal. They checked box B of the defenses out of the. cookbook of sex abuse defense lawyer stories. And that's what's going on. David Jane Doe's attorney told us she has been getting. threats, but he described her as fearless and determined. to make college campuses safer for women. David. Aaron Katersky on this. again tonight for us. Aaron, thank you. Tonight, our team on board the USS Lincoln following its. record deployment for the war with Iran. After reports, eight sailors in the carrier group attempted.

to take their own lives. ABC's Trevor Ault now on board tonight. Tonight our team boarding a Navy Osprey flying us from San. Diego to the USS Abraham Lincoln aircraft carrier docked off. the California coast and now just hours away from returning. home. It's about a 20 minute flight. for us from San Diego to get to the USS Abraham Lincoln. It has been deployed now for 320 days. Record-breaking deployment has led to reports of plunging. morale and poor food, including 265 days without visiting.

a port, the longest stretch in naval history. Images of the carrier had shown some wear and. tear, including rust. I spoke with Precious Aguirre, an IT specialist on board. Has this been the hardest thing you've ever done? Honestly, yes. This is a very tough deployment. Yeah. What made it difficult? It was the conditions around the boat honestly, and not only. that, it was how dangerous it was too. And David, with the Lincolns set to finally make port tomorrow, morale is now incredibly Every sailor that I talked to.

is very proud of what they did here, but they are ready. to get off this carrier and see their families. And finally back home, Trevor Ault tonight. Trevor, thank you. The midterm elections tonight, President Trump now making his. third campaign trip to Texas in a month. Both the Republican governor and the Republican. Senate candidate trailing their Democrat opponents. And tonight, a new audio, the Republican Senate candidate. blaming the president's war in Iran and gas prices. Here's Mary Bruce. President Trump tonight heading to Texas, his third visit in a.

month as polls show Republicans trailing in the races for. both Senate and governor. President Trump there to prop up the struggling Senate campaign. of Republican Ken Paxton. In recorded conversations with donors, Paxton. blames his problems on the president, saying. Trump's midterm convention in Dallas hurt his campaign, and that the war with Iran is dragging him down. The war is gas prices. It's diesel. A lot of trucks are diesel. People are feeling the pinch.

I asked the president about that. Do you agree with Ken Paxton that the war and. gas prices is the biggest challenge for Republicans? I think the war is, when you call it a war, it's a war that's. been won from the standpoint of what we have to do. We have to get rid of no nuclear weapons. for, as you know, for Iran. We've essentially accomplished that. It'll be over very quickly. And when it does, And when it does, oil prices.

will come tumbling down. But across the country, Republicans are distancing. themselves from Trump in many races that weren't. supposed to be close. In Maine, Republican Senate candidate Susan Collins. debating Democrat Troy Jackson. Collins calling herself a "outspoken opponent" of. Trump's trade war with Canada. As an example, she says she was able to get road salt. exempted from the tariffs. - Troy mocked it, but I was successful in. getting concrete, pulp, and road salt removed.

from the tariff list. - I didn't mock the fact that she got road salt back. I mocked the fact that what about everything else? I mean, we can't eat road salt. - And back to Texas, where the president is tonight. David, it is remarkable that both the races for governor. and Senate are so tight. The president today was asked if he regrets endorsing. Senate candidate Ken Paxton. Trump says he has no regrets. David. Mary Bruce, live at the. White House tonight. Mary, thank you.

Tonight, here, the ABC News investigation, the neighborhood. where families were forced to move out of their own homes. after what was discovered underneath, the ground beneath. them giving way. There was an old mine underneath. They're still paying mortgages on the homes. they cannot live in. So Jay O'Brien and our ABC stations investigating. This is Daisy Drive in Hideaway Hills, South Dakota, where 13 families were living the American dream. Tonight, those homes now sit empty, weeds growing through the cracks in the concrete driveways.

Those 13 families were forced out, having no idea what was lurking underneath their homes. ... until a 30-foot sinkhole ripped open, revealing a. hidden danger below. They were living over an old mine. What they found underneath here was a network of. mine shafts, more than 100 years old, extending. from this massive hole in the ground all the way up the street. and into that neighborhood, where many people still live. Many still paying for the homes they cannot live in.

We brought many of those homeowners. [END PLAYBACK]. Raise your hand if you knew there was a mine or. mine shaft under your home when you bought it. Nobody. Did you think there could be? No. You had the American dream. I thought I did. Got ripped right out from under me and turned into a nightmare. Marshall Dalton's insurance did not cover this. So this is your house?

Six years later, he's still forced to pay a mortgage he. can't afford on an empty home. An ABC News investigation found there are abandoned mines. across this country, and in many cases, no easily accessible. public records of them, many of them giving way, the earth. opening up, like that sinkhole on Daisy Drive. We wanted to know why homeowners are not protected from this. We took our questions to the Department of the Interior, where officials acknowledged they don't know where.

every abandoned mine sits in this country. There potentially can be mines out there that we would have. no idea that they are there until they express themselves. in some adverse way. Express themselves meaning cave in. Yeah, so there's just no way for us to know that. What would you say to that person who's worried. that they're living on top of abandoned mines? I would say that it's a genuine concern. We learn there is some federal help when it's a coal mine that. falters, but it's no guarantee. And any other kind of mine, like that gypsum mine back in.

South Dakota, there's little to no federal help at all. So tonight, a team of ABC News data reporters have now built. this, a map of every mine we could find in past. government records to help future homeowners, something Alison Ireland, a mother of four. wishes existed before. - It was made for a family. - And now it's empty. - And now it's empty. - David, Allison and those homeowners. sued the state of South Dakota, which once ran that mine.

The state said it was no longer responsible. after it filled in parts of the mine. and sold the land decades ago. After a long legal battle, the state won. David. - Just incredible, they're. still paying mortgages on these empty homes. Jay O'Brien and the team, incredible reporting. Thank you. We turn tonight to Russia, the U.S. issuing a formal complaint now to the Kremlin over. its response after the death of a young lab researcher. Russian officials claim she contracted severe pneumonia. President Trump saying he has a call set up with Vladimir. Putin, but saying if you listen to them, it's under control.

Russia's health agency insists there are no epidemic risks. Tonight Israel marking three years since the October. 7th terror attack by Hamas. >> Good evening, everyone. We're in the middle of a protest.
